Timeline

I have at least 3 years of W2's and tax information directly from the IRS, all showing that I make about at least $7,000 above the 125% poverty level. My question is on the I-134 form (Affidavit of Support) does it make a difference if you have less than $1,000 in the bank account?

Also, I own a mobile home, should I put that on the I-134 under "I own real estate valued at" or should I put it under "I have other personal preperty, the reasonable value which is"?

I believe you only need to provide your bank account information if you don't meet the income requirements and need to compensate, since you do, I don't think it matters how much you have in the bank, same goes for the mobile home.

Timeline

If you earn an amount above the Poverty Guidelines, then you do not need to provide any other financial information.

You will still need the letter from your bank stating the date the account was opened, the total amount of deposits made in the last 12 months, and the current balance. The amount of money you have in your account is not relevant. They are just trying to confirm that you in fact have regular income going into your bank account.

Well the guidelines have been updated and you are only required to send in your last current tax info. Grant it I'm sure it won't hurt if you send all 3 yrs. Also your current balance in your account shouldn't effect what income you currently make regularly. As long as you meet the 125% guideline you should be fine.

When I completed the I-134, I had just returned from my 3rd trip in 6 months to the Philippines and my savings account was completely depleted. My income is well over the requirement, but I thought it would be fun to note the $5.60 I had left in savings :lol: Yes, I put it on the form, but I didn't need to. I guess it just gave me a smile. We had no problems with it, but you can certainly leave it blank or N/A.

I just did my I-134 and it specifically states you only need the last years tax returns. Not 3 years anymore. Also need the bank statement and proof of income from employer. I provided Leave and earnings statements and signed letter from supervisor stating my income level. Bank statement shows total deposits made in 2005, current balance and date account opened, it is signed by bank official. The instructions on the form are very specific and doesnt make any difference on how much you make. If you own the mobile outright that counts as additional assets only.

Well, if you're self employed, than you need your tax returns, but you don't need a letter from your employer (cuz then it be a letter from yourself?). If you're not self-employed, than you need the letter from your employer, but not your tax returns.

BUT, that all changes if you get your NOA2 after July 21st, which will probably be most of us!

I don't know. I'm trying to figure all this out myself :huh:

I believe it will only require you to submit your latest tax return and nothing else. I can't find where it was discussed, I looked on the USCIS website and it only talks about I-864

That only applies to those who receive their NOA2 on/after July 21 I believe.

I have no idea what you are talking about? I-134 will be looked at by the US Consulate processing the case. They don't care when the NOA2 was, as long as the Petitioner meets the poverty guidelines.

The change in the number of tax returns, along with the 125% above the poperty level, apply to the I-864 which is used for AOS.

A mobile home is personal property, not real estate. If you own the land that the mobile home is sitting on, that's real estate.

As to the amount of your savings, $1,000 isn't much - you could live on that for how long? And what you've made for the past 3 years is helpful, but how much are you making currently? That's what pays today's bills, that's what counts the most.
