AUGUST 2009 AOS FILERS - progress reports

hi August fillers,

I am really panicking, cause I missed my biometrics appointment.

I had called USCIS many time asking them when I would receive it and they told me to wait... Of course I had no idea that the letter was already at my brother in law's...

My mail arrives at my brother in law's address cause we are travelling every week and therefor don't have a fixed address...

So now I don't know what to do :(

It says on the letter that he scanned me today: If you don't make it on the scheduled appointment, your case will be considered abandonned :(

I have not abandonned anything, I just have a very stupid brother in law that I can't trust apparently , that gives me my mail WAY too late...:(:(:(

Any idea of what I could do?

I already scheduled an infopass appointment on Monday first thing, but I am so scared that they have already abandonned my case :(:(:(

Has that happened to one of you? If so, how did you get out of it?

Any help would be greatly appreciated!

when did the mail arrive at your brother in law's house? i hope all goes well with your biometrics. maybe you can look for a timestamp at the post office if they delivered your mail late.

He got it a while ago. He only opened it yesterday. I sent him to the office where i was supposed to go ( It's in Colorado, and I am in Pennsylvania right now) and explain to them that he ###### up, he didn't open the mail and transfer it to me. There is no need to lie and say that he didn't receive it. He simply didn't open it on time...

I am praying that they will listen to him and that the person he will talk to knows the show my husband works for and understands that we live a very special life, which makes us not be able to get our mail ourselves.

Please pray with me that they will listen to him and not abandon my case :(

IN the meanwhile I cannot do anything of my day... just wait and pray...

I'm very sorry to say this, but to me it looks like only you, not your brother, are responsible for this. Every time you move you must announce your new address to USCIS. Otherwise they treat it as breaking the rules.

Looks like things are moving along, at this rate we will get some AOS approvals shortly that would be great

I know I am not the only one with an interview :unsure: who else has one... I know they havent added themselves to the spreadsheet.. I am still waiting for my ssn hope it gets here this weekend so I can start filling out apps and get my id

I added us to the spreadsheet... our interview is 10/19. Just a couple of weeks away... eeek! SO not prepared like normal. :(

i didn't know that waiting for an appointment notice would be this stressful lol

i called on USCIS and was able to talk to a customer rep. informing her that 30 days has passed and still i haven't received my biometrics appointment letter. the info she gave me was the same as the USCIS website was giving me.

I'm wondering, if one were to call USCIS, if they'd be able to tell you whether or not the DS 2035 (vax form from K1 medical exam) was completely filled out or not.

I found the following infromation from the USCIS site.

Medical Examination

If you received a medical examination prior to admission as a K nonimmigrant, then you are not required to have another medical examination at time of adjustment as long as:

Your Form I-485 is filed within 1 year of your overseas medical examination

The medical examination did not reveal a Class A medical condition

If you did have a Class A medical condition, you received a waiver of inadmissibility and you have complied with the terms and conditions of the waiver

Even if a new medical examination is not required, you still must show proof that you have complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit Part 1, Information About You, Part 2, the vaccination chart, and Part 5, the Civil Surgeon's Certification, of Form I-693 (in an envelop sealed by the civil surgeon). Please see the instructions for Form I-693 for further information.

We received AP in the mail today. It was approved on Sept. 30th, same day as EAD approval. Ironically we received a second email today stating that EAD was just approved, though we already got one on the 30th. From some other posts, this seems common enough. Hopefully it'll be arriving in the mail soon.

Now just waiting for the GC. I'm interested to see if the transfer to CSC speeds up the process at all.

My AP was approved on the 30th as well, still waiting... EAD was touched the same day but nothing has changed in its status so far... Hopefully they have just forgot to update it! :devil:

My I-485 hasn't been touched since they produced my bio letter. It would be nice to know if/when the interview will be so I can think ahead a little. And I'm still not sure If I should/need to get the I-693 done for the interview. How many people have received RFE's for this at the interview stage? Does anyone know? I have an appointment to get my third Gardisil shot in 2 weeks, but I don't want to bother getting the form transcribed unless I really need to...

We have similar timeline and I haven't heard nothing yet either, so we are in the same boat.
