Anybody doing NVC in August??

Yep, thats' what it sounds like, Mohan...

that's exactly what happened with me. Even though your package of docs is IN the building, it doesn't always mean that it's been put in the system. And once they start an RFE, false or not, it keeps on going until it reaches fruition. With mine it then switched to, we have received the checklist document and will let you know in 4-6 weeks once we review it.

So, now? We wait.

To be honest with you? I am expecting something tonight as they seem to have a bad habit of generating an RFE, false or not, on Friday evenings when you have to sit and stew about it for the whole weekend.

This time Liz picked up the phone.

The RFE is about DS-230 for the beneficiary. However, she says we recieved a package and that package has not been opened yet. Please allow 2- 4 weeks and we may be able to give you an update.

So , bottomline, this was a false Alarm. They reviewed previous package and found DS-230 missing. Of course. Its not even opened.

Second, The AVR this morning said, " NVC reviewed your documents and found missing information. A letter has been sent on Aug 7th..."

The Same AVR now says, "NVC reviewed your package and found missing information. A letter has been send on AUG 6Th"

I am not sure what to beleive but one thing for sure, Do not rely on the AVR. Speak to an operator in such cases.

This line made me chuckle, I hopethey open the package today, and I have something by tuesday.I cant imagine more than 30 minutes to go over a well organized package, unless they check each and every word, with Cigaretter and Coffee breaks in between. :)

This time Liz picked up the phone.

The RFE is about DS-230 for the beneficiary. However, she says we recieved a package and that package has not been opened yet. Please allow 2- 4 weeks and we may be able to give you an update.

So , bottomline, this was a false Alarm. They reviewed previous package and found DS-230 missing. Of course. Its not even opened.

Second, The AVR this morning said, " NVC reviewed your documents and found missing information. A letter has been sent on Aug 7th..."

The Same AVR now says, "NVC reviewed your package and found missing information. A letter has been send on AUG 6Th"

I am not sure what to beleive but one thing for sure, Do not rely on the AVR. Speak to an operator in such cases.

i have seen a lot of "false" rfes

seems that if they start reviewing the AOS and have not yet the applicant doc they start a RFE

it is important to talk to operation when it says checklist sent

checklist is an email

in my case it was saying sent but had not been sent yet

and I was able to fix one problem via email based on input of the operator

sometimes operator does not tell you all

just reads issue 1 but does not look for all

don't hesitate to ask

anything else?

will try to scan for Beth today before going to the airport

going for weekend this afternoon to pick up my son at his grand parents

no scanner there and will be busy (glad) with my son. missing him.

Oh no...

it's okay, Mohan... just call them back later today and see if it's in the system yet. Is is possible it's a false RFE like what I had? Like they haven't processed one of the packages? For mine, I guess they'd finished the I 864 and were looking for the DS230... perhaps that's it.

Call later today and see what the AVR says AND what the operator says.

As for the I-864ez, can I use that even if I have a child? I didn't know.

The question is a bit vague. do you mean you have a child at home, or you are Also doing I -864 for you child, Meaning you also petioned for your child.

I suppose I should have been a bit more clear. I have a child, my dependent, at home with me. If you have a dependent can you still use the I-864ez or do I need to use the I-864 ?

My other question is what do you think is taking them so long to send the petitions from USCIS to NVC lately?? This is probably a stupid questions, but do they collect a bunch of "approved" case and then send them all in to the NVC?

Oh you thought I was done....nope, I got more questions.....hubby had something translated and then signed off on by the U.S. embassy in Cairo as "certified." We need his Police Clearance from Cairo translated to English as well. Now, I thought he could just have it say it's certified by the translator as being competent to translate, although after reading what, I think, Lgg said then sounds like he should still have it "certified" by the U.S. Embassy in Cairo. True??

To answer your first questions this is what I have from the Form itself. Looks straightforward to me and I think you do qualify to file I-864EZ . The key here, As I understand, is " the relative your are sponsoring is the only person listed on the form I-130" . If that is your case then, I would say yes. Below is what I find from in the form. And now makes me think I could have used it as well, becasue of Box C, in part 1 of the form . However I filed I-864 for both my cases. If still in doubt, I would call NVC or just go with I-864 :)

1. You are the person who filed or is filing the Form I-130,

Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on

the Form I-130 petition;

3. The income you are using to qualify is based entirely on

your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s).

Further detailed clarification below : This is actually from the PART1 of the Form itself.

You may use Form I-864EZ if the statements in 1(a), 1(B) and

1© are all true. If you cannot check "Yes" to all three boxes,

you do NOT qualify to use Form I-864 EZ and therefore must

use Form I-864. Submission of the incorrect form will delay

processing.

a. Check "Yes" if you are the petitioner who is filing or who

has already filed Form I-130, Petition for Alien Relative;

Form I-129F, Petition for Alien Fiance(e); Form I-600,

Petition to Classify Orphan as an Immediate Relative; or

Form I-600A, Application for Advance Processing of

Orphan Petition.

b. Check "Yes" if you are using only your own earned or

retirement income that can be documented with an IRS

Form W-2. If you are self-employed, you must check

"No" to the question and you cannot use Form I-864EZ.

c. The term "immigrating with" in this statement means "on

the same visa petition". Thus, if the person you are

sponsoring is an immediate relative (spouse, child, or

certain parents of U.S. citizens), you can automatically

check "Yes" for this box because every immediate relative

has his or her own visa petition. If the person you are

sponsoring is a family-based preference immigrant, and

the family members listed on the same visa petition are

immigrating with or within 6 months of the sponsored

immigrant, you must check "No" for this box and you

cannot use Form I-864EZ.

Second question, Yes they are trying to bundle up approved petitions and then send them to NVC. This was confirmed at some point I beleive by Simps, another Great VJer, and the link is , "July Approvals lets do NVC together" or something like that.

Third, i am not sure :blink: may be others can chime in as well.

Ok, all just got an email from NVC. It is a check list that tells me to file I864w

Intending Immigrant tmust complete and submit an I864w. has anyone heard of this before. When i called NVC , they told me i need to two seperate I-864. Now they are asking this from a child that is 26 months old? I was told that being a biological father of a minor, i could send in his docs. so i filed DS-230 and I-864 for him . Do not understand.

Any Idea. I need help.

Ok, all just got an email from NVC. It is a check list that tells me to file I864w

Intending Immigrant tmust complete and submit an I864w. has anyone heard of this before. When i called NVC , they told me i need to two seperate I-864. Now they are asking this from a child that is 26 months old? I was told that being a biological father of a minor, i could send in his docs. so i filed DS-230 and I-864 for him . Do not understand.

I am pissed off that i could not find this information when i was doing all sort of research on the interent and all kind links and threads and what not on VJ.

And now I get RFE for this . What The F&*K!!!

Anyways i will talk to you after work. thanks for being there.... AND NVC oerpators dont suggest what to file either. how come the opertator i was talking to did not tell me thsi, when i mentioned here that my child is only 26 months? instead she said she could not provide legal advices.
