insanely detailed timing question

We must file for my husband's ROC on the very first day possible so that he can get the NOA as soon as possible and show this to his school so they'll let him attend in the fall. If he doesn't receive it within a few days, he'll make an infopass and ask for an I-551 stamp to extend his status through the end of the fall semester. The school won't budge on this. The package is all ready to go.

Sooooo Saturday the 8th is 90 days before his conditional green card expires, but I read here that the package should not actually be received before the 89th day prior, so that would be Sunday the 9th (I'm afraid someone would be working at USCIS on Saturday and turn the package away). We are going to send it by Express Mail, and the post office here is open on Saturday morning, so should we send it Express on Saturday morning to arrive, I guess, on Monday? I'm getting induced on Friday the 7th, so my husband and I will be in the hospital all weekend, and a family member has volunteered to send in the paperwork -- that's why I'm trying to be so precise about the timing; have to give them instructions in advance.

be very careful about dates, couple days mistake on calculation might cause you more delay,

are you sure his 90 days starts saturday 8th?

if you making your calculations by substracting 3 months from expiration date of his card then you might make a mistake..

What is the exact expiration date of his card?

say if it's november 8th then his 90 days period starts august 10,not august 8th.

use a date calculator, here is the link

then put 90 days at the bottom, and switch from add to subtract..

For what it's worth, we mailed our AOS packet on a Saturday, Priority Mail. According to the USPS, it was delivered the same day :wacko: Then again, we mailed it in Chicago and it was sent to the Chicago Lockbox. When we got the NOA1, it was dated as being received on July 12, which is a Sunday. So they must pick up mail on the weekends.

2009-07-11 AOS packet mailed (and supposedly delivered the same day)

2009-07-15 NOA1 for I-485, I-131, I-765 (USCIS rec'd date is 07-12)

2009-08-05 Case transferred to CSC

2009-08-12 no biometrics yet.......called on 30 day mark to report no biometrics, a service inquiry has been made on the case.....

2009-08-25 - received Biometrics appointment letter!

2009-08-27 I-131 (AP) approved

2009-09-15 Biometrics appointment

2009-09-15 EAD Card production ordered!

2009-09-23 EAD Card received

2009-10-06 GC approved/card production ordered

2009-10-13 GC received in the mail!

Thank you for the warm welcome :D I totally agree with you -- this is the way it SHOULD be, and I believe the school's policy does violate federal law -- they took the state's requirement and went too far with it to make their own jobs a little easier. We have written several letters, made several visits, but the school would not back down. If we had the time and energy, we'd fight them harder on it now. Once he's safely in school for this semester and I've recovered completely, I'll start advocating for them to change their policy so the next person in his shoes doesn't have to go through this. Timing was just lousy and we had to pick our battles. We've already contacted one representative, and we'll keep going with it until they fix this. We just had to do the best we could with what we had to work with in the time allotted at this point.

As for the I-551 stamp, here's the result for the next person to go down our path: USCIS received my husband's ROC package on August 10th, so we should be fine on dates. This morning, he took proof of delivery, his Infopass confirmation letter, all correspondence between the school and ourselves about this, an exact duplicate of his ROC package, his passport, and his green card down to the Charleston, SC field office, two hours away. He called me a half-hour later. He said at first they didn't want to give him the stamp, but they finally reconsidered and gave him the stamp in his passport with a six-month extension but took away his green card. So he can now prove to all the clueless bureaucrats out there that he is in status at least until May of 2010, and as soon as the NOA arrives, he should have proof through November of 2010.

I know this isn't the OT forum, but as an aside, I'm darn proud of my husband.

I don't know why they took away his GC. It is still valid for about 90 more days. USCIS can do what they want to do.
