CR-1/K-3 Confusion

OK, our I-130 has been accepted and we are now moving to NVC. We are officially filing for a K-3 Visa, but from all I've read, our I-130 automatically applies us for a CR-1 visa, which seems like the faster route for us to go now. Do we need to do anything at this point to change our status? I-130 NOA2 was issued on 8-3-9. I-129 NOA date May 13 is still pending. Any advice? Am I the only one confused on this issue?

It takes 8 months for us to see each other back again since we started our visa process, and now here we are reunited back again and happy together.

Your not as much confused as underinformed.

When you fully understand the difference in the two visas & the related expense of the K 3 you will probably want to forget the K 3. The C R 1 is simply a better way to immigrate. It ends the nightmare of doing the AOS which is another added year of the unknown together with the 1,010.00 dollar expense.

Your petition is approved as you know & that is good. Now on to NVC for the next steps. Educate yourself by reading the guides here on V J. Find the NVC flow chart to see how they function.

You are not the only one confused by the immigration process which is exactly why V J is a great place to come for help. The confusion becomes enlightenment as you go forward on the journey.

No you don't need to do anything. Your spouse in the Philippines will get the packet 3 for K-3. Just ignore it. As far as the beneficiary, you will two notices from NVC with two different case numbers. The I-129F/K-3 case number is just simply informing you that it has been forwarded to the consulate. The important one concerns the I-130/CR-1. You will receive a bill for $400 and $70. Follow the instructions from them. Also read lingche's guide on getting through NVC quickly. It spells it all out. OK, thank you. That's good info to have, and just what I was looking for. I'm sorry I've been testy in my search for info here, I've just been frustrated. I thank everyone who has been here to help.

No you don't need to do anything. Your spouse in the Philippines will get the packet 3 for K-3. Just ignore it. Greetings!

When both our application were approved. I chose K3 visa, emailed NVC to hold on to our I-130 that was approved and told them i am going to k3 route, hubby also called them to make sure of our plan.

entered USA with K3 visa but come to find out the hassle of all the docs needed and all other applications that goes along with it not to mention the waiting game.

1. entered USA with K3 visa.

2. applied AOS.adjustment of status, you would not believed how many docs and evidences needed. the fee before was cheap now it is $1,010.00

3.went for biometrics.

4.AOS interview.

5.green card rcvd in the mail (conditional)

6.since marriage is less the 2 years at the time of AOS interview,conditional green card was granted.

7.applied to Lift condition, to make green card good for ten years. $465.00 inclduing biometrics.

8.biomterics

9.interview

10. 1o years card rcvd by mail.

my own opinion: big hassle ,waiting game kills me from waitng for the docs to be rcv or if it was rejected, from waiting for biometrics notice to the biometrics day itself,from the hassle of asking day off from work so i wont missed it. not to meniont the fees. i just wish i went to CR1 route.

CR1 route:

1. USCIS approved the case.

2. NVC assigned a MNL case number.

3. NVC will now begin to further to process your case once Choice of Agent is known.

4.$ 70.

5. $400 visa fee.

6.Agent of choice and you is the key to make this process goes faster. if you are quick enough to have docs ready and agent of choice is up and ready to pay the fees online then you can finish NVC process within a month or less. Completeness and readiness to respond right away is very important.

7. Once NVC completes the review of the case then it will inform you as to when is your interview date.

8. enters USA on CR1 visa that means you can work right away.

I think my reading comprehension skills are just fine, thank you. I am not here to disparage anyone or pick fights. I'm just here for answers to questions that others before me on the journey might be able to help me with and to answer and help others who are newer on the journey than me. I'd like to keep things positive for everyone. I understand the difference between K3 and CR-1 visas. My question was simply what action do I need to take to signify that I would like to pursue the CR-1 instead of a K3. You responded with reasons why the CR-1 make that a better choice than the K3. I appreciate that advice, but my question was, how do I switch my official application to a CR-1? I've done plenty of research on the matter, and I think it is clear from my initial posting that I was just looking for advice on how to change our filing status. I'm not looking to take shortcuts or have others do research for me. Once again, I don't want to be disparaging here or picking fights. I think we all need to be positive and help each other here. I simply asked how to change our status from K3 to CR-1. You responded with a list of reasons why the CR-1 is a better option than the K3. While I thank you for the advice, that is not the question I asked, I was looking for information on officially changing the status we are seeking. So while you are flaming on me for asking the same question over and over again, it's because your response did not address the question I was initially asking. And then I get accused of being here merely to avoid doing research into the question I had. Back to topic. Be prepared for your spouse to be a little disappointed when you tell her to throw the packet 3 for the K-3 in the trash. My wife was a little devastated by that. It looks like it will show up soon in PI.

Get everything from her for the CR-1 as stated before. Original marriage cert, birth certificate, police report etc. She will need to send those to you here in the US. You will then need to submit those to NVC here in the US. The nice thing about the CR-1, is that it takes a little pressure of your wife. She will only need to do the medical and the interview. You will be paying the fee at NVC etc. It's really the much better way to go all the way around.

I think in the Philippines the have some crazy seminar she has to go through before they will allow her to exit. You can probably find out more about that in the PI forum

OK, thank you, my wife is also furiously researching our options on here. She has another login name from me, so it shouldn't be a shock to her to be discarding the K3 forms when they come in. I will just be looking into the forms I need to fill out here on our behalf. I am thankful to have the support of others who have gone on this journey before. It is truly a blessing.

I will just be looking into the forms I need to fill out here on our behalf. I am thankful to have the support of others who have gone on this journey before. It is truly a blessing.

I paid $1800 to a lawyer who delayed my case no less than 3 months. I corrected no less than 10 of his mistakes thanks to this website. If your case is straight forward, this is the place to be.

You can flame up if you want. If you read & understand my responce before it is the answer to your question. I said your petition is approved. Just follow the steps at NVC. For a K 3 there is NOTHING for you to do at NVC. Taking action at NVC by following the required steps results in a C R 1 visa. That IS the answer to your question & it is a positive responce.

What I said was very positive. Isnt it you that said you were testy? Testy? You are underinformed , confused & ignorant. Wasnt it you that was demanding, pleading for a responce. You were looking into the Universe & whining about the fact no one would respond.

I dont care what your temepture is pal.

The crazy one day seminar is a requirement by the Philippine Government and the fees is about 500 pesos. It is not a big deal. My wife went through it. Good luck on your journey.
