I have an approved I130 for my daughter who is 9 months old now. I'm a USC but when she was born I was an LPR so I did have to go thru the I130 process. Now the case is about to be submitted to NVC.

I know I'll need to send my daughter's birth certificate, her passport's copy and AOS exemption (I864W) to them. How about for DS-230. The majority of questions do not apply to an infant. I was even amused by the languages spoken field - of course at 9 months old she doesn't talk at all yet. I guess I'll have to put the languages I'd like her to speak in the future :-)

But seriously, anybody out there gone thru the same process with an infant? I could use some advice. Thanks.

No, she's in Canada with my wife. As I explained in my post she was born before I became a citizen, which means she wasn't a US citizen at birth. This is why we're going the IR-2 track. But she will become a US citizen automatically upon arrival in the US.

Parent or legal guardian can sign.... could be something like Jane Doe, Mother on behalf of Sarah Doe, a minor child

FWIW, a minor typically has no legal capacity to sign anything to make it legal and binding

I'm gonna sign for my daughter. Typically you sing and then type or write: (for minor). It's perfectly acceptable. Now another funny thing. Since I need to send the AOS exemption form I864W, it is meant to be filled out and signed by the beneficiary. In this for you basically state why an AOS is not needed. In my case this is because my daughter falls under the Child Citizenship Act of 2000. So pretty much this form should be completed as if it was my daughter making that claim. Now towards the end of the form is a concluding provision that goes like this :

"I, ........................................, certify under penalty of perjury under the laws of the United States that:

a. I know the contents of this exemption request which I signed;

b. All the statements in this exemption request are true and correct; and

c. I authorize the Social Security Administration to release information about me in its

records to the Department of State and U.S. Citizenship and Immigration Services."

and then there is a field for a signature. Well I need to sign this form so whose name should I put in the dotted space? Mine or my daughter's? I would say hers but then she's not really able to certify anything.

Anybody done that form before?

I would call the NVC and get advice from them as to who should sign for a child and what exactly you need to put on the forms. I found them to be very helpful.

Hi I am in the exact situation, I had applied for my 14 month daughter, and by reading your case I have learned that, as a child of a USC she is exempt of an AOS, and that instead I have to send the I864W exemption form. I hope somebody can answer your question regarding the signature on this form and on the Choice of Agent form. Thank you
