Re-marrying a foreigner after divorce

I have a general question for someone who asked me. This person married (married (civil) and divorced in NYC) a person from another country and filed her paper work based on Fiance visa, and got the ten year GC and the marriage did not workout the way it suppose to be and ending up with divorce. Now the question is, is this person can get marry again to a foreigner and how will immigration will look at the old marriage? Will be the process be slow and any other precautions ? What will be the right way to go for it? If anyone in this forum have answer to the questions above or have better knowledge, please respond... thanks.

For sure it will be under a bit more eyeballing because of the previous marriage - but it shouldn't be that bad.

Precautions? none that I am aware of, other than stick to the truth.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The other questions you need to ask your friend is whether the IMBRA laws affect her, like did she meet the new fiance through an International Marriage Broker and how many times has she filed K-1 applications. This person may find it necessary to request a waiver.

They should review the IMBRA law before proceeding, and of course it's a good idea to let the new fiance know about the past failed marriage.

I agree Bobby 100% and depending upon the country they could really 'eyeball' the situation... VN would require an extraordinary amount of proof of bonafide relationship in this case...
