NickD's posts are often more philosophical/reflective in nature and share some insights by comparing and contrasting different systems in the US, which many of us enjoy...

There's only one contact number for USCIS - it's on their website, 1-800-375-5283, to get by the automatic system you can select an option like Change your address, which will put you through to a person, and you can ask your question (may or may not get an answer that you like, since they tend to parrot scripts). But the guidelines/specifications are all laid out in the M-476 and you can look up the specific CFRs etc via Google to read the legal language that's the foundation for the eligibility/criteria for naturalization.

We've all been around the block to get this stage, and there's no substitute for doing the homework - we've all had to... good luck in your research and your N400 journey (F)

I have read up on stuff and with adding up all my time spent in the usa in the last 3 yrs does seem to be over the 18mth mark as there has not been any breaks over the 6/12 mths outside the us...so it looks like i could be fine, but still im going to go to the local ucis office and speak with somebody before i file just to cover myself...

Anyway seen a link on the uscis site and you all proberly seen it but just in case ill send the link here for members who have'nt

Note that you've got to meet the requirements on three separate days: On the day you file, on the day you are interviewed, and on the day you take the oath. If you miss the requirements on any one of these days, even if you only miss by one day, then you can't become a citizen and you have to wait until you meet the requirements and file again, paying a new fee.

So it's worth checking to make absolutely sure you meet the requirements before you file.

I did read up on IF.. outside the us for more than 6mths rule while you have a P/R card and it states that, you must show prove that you and your spouse was living/working or fileing IRS tax returns or any other prove ....the bottom line is they want to know you was both togethere as a married couple during that 3yr period of your P/R

So being its touch and go at the moment for me, is there a customer service centre i could call and speak with a human? instead of a robott that they normally use...would you know of such a number i can call?

Mellow is hardly the word of choice when dealing with a Gestapo agency like the USCIS, you are guilty of fraud before you even walk in. And for the most part, dealing with very incompetent people that think they are gods. Nigel should know this with his time line. Very typical of our legal system to run over the people unless you have means to level the playing field. One method is to hire a very large law firm, they respond quite differently to competent people that know the law better than they do. And do not tend to give you the runaround. Another is to have as a friend a senator or congressman, that is preferably on the committee that regulates the agency in question. But the bottom line is, you have to know the law yourself by reading and studying all the material provided by the USCIS and complying fully with all the regulations and requirements. Even going beyond the requirements.

An easy way out would be to hire a very competent attorney, will lead you by the hand, as my attorney told me, if the USCIS made it simple, he wouldn't have a job. Just hope that Nigel receives the correct information with his infopass, but suspect he will be told to read the book. Can only wonder how many employees of the USCIS read the book.

The "physical presence rule is "set in stone" , you must meet the number of days or your will be denied. There is no grey area on that one. So, stop being lazy, look at your dates, and work this out exactly.

Re "continous presence" - provided your trips are under 6 months, and not "back to back" you should be fine. If they are between 6-12 months, it is up to you to prove to the IO (to their satisfaction)that maintained residency in the US for that time.

Good luck with your infopass appointment - though, personally I doubt they are going to be able to give you any more info than you could gain from thoroughly reading the website.

I can be prickly as anyone on here but I am always very grateful when I get good advice and that's what you have been given by very helpful members
