Hi there!

My fiance just called me cause he doesnt know exactly how to handle this affidavit of support.

His last tax return shows enough income to support me. But now he went back to college. Though he is student.

His dad will be the co-sponsor.

1. My fiance has to fill out this sponsorship form, too. Right? Should he say he is a student? Will it be confusing for the immigration people if his last tax return showed an employment? Should he even put this in? Does he need any paperwork saying he is enrolled in school right now? Should he put in anything saying that he gets support from the army to go to school (he is not in the army anymore, but he gets money for college)? Or does he need no evidence at all, cause his dad is the "real" sponsor?

2. His dad, co-sponsor. Is it enough evidence to put in an bank statement, and paperwork from working (saying for how long he is employed in that company and is salary)?

Please help me, I dont know what to tell him....

Mar 2006 went back to Germany

Jun 2006 he came to visit me in Germany

Jun 17 2006 big official engagement party

Jun 30 2006 he went back to the States

On the I-134 instructions it tells you what you need to provide for evidence. Any income should be reported. As co-sponsor his dad will have to provide same information. Both will have to do I-134.

Hi! In regard to your first question, yes your fiance' absolutely has to fill out the I-134. Even if he has no income, since he filed the petition for you and you are coming her to marry him, he needs to be the primary sponsor and fill out the I-134 and provide all the evidence he possibly can even if his dad is the "real sponsor" in terms of money he can contribute, etc. I believe he can use his financial aid money as income, so have him send a copy of the financial aid award letter (or whatever they sent him) saying he gets $XXXX.XX per year or semester or however it's arranged etc.

For his dad, his dad should supply as evidence, in addition to what you stated, copies of some pay stubs (at least 3), showing steady employment and his monthly salary, etc.

10/2/2006: NOA1's for AOS and EAD applications

10/13/2006: Biometrics taken

10/14/2006: NOA -- case transferred to CSC

10/30/2006: AOS approved without interview, greencard will be sent! :)

11/04/2006: Greencard arrives in the mail! :-D

... No more USCIS for two whole years! ...

Not necessarily. You are applying an I-864 immigration requirement to K non-immigrant visa situation. The consular officer may or may not require an I-134 from the petitioner if someone else is going to be the sponsor for the visa.

Thanks alot! That was really helpful! Though puting in his financial aid letter is a good thing? My fiance wasnt sure about it cause it pretty much shows that he ows money - I mean at the end thats what it is, isnt it?
