i need to ask u about help one more time :blush:

We are getting a co-sponsor and he is married and have a son.Does his wife n a baby are wholly orpartially dependents? what does it depend on? i be so appreciate for your help once again!

Wife and son are dependents. From what you have posted he will have to use the poverty level for 4 himself, wife, baby and your fiance.

Update and if I read your other post correctly then your fiance and you have a child so that would add another to the mix so poverty level of 5

(I assume this is for an I-134)

If his wife has her own income and it is shown on a joint tax return which he submits as documentation then he does not have to count his wife as she has her own means of support. The child is counted as wholly dependent.

He should attach documentation of only his income, only one person counts for the I-134.

For the co-sponsor they would count anyone listed as a dependent on their last tax return (plus any kids that may have been born into their family so far this year) as household members.

As Gary pointed out, the co-sponsor is a single individual (meaning only 1 person can be the sponsor, married or unmarried) and you would exclude their spouse's earnings if they have a joint return. I wouldn't try to allocate the kids as far as dependency. If it's that close, find another co-sponsor.

With regard to your USC fiance(e)'s I-134, your USC child would be considered part of the household count. For the co-sponsor they are just adding 1 (the K1 immigrant) to their household count.
