Filing for 2nd K-1 ADVICE NEEDED

Did you have any contact with your current sweetheart between June, 2008 and February, 2009?

FROG,

Your avoidance of a tough question might make one suspect that your previous sweetheart's abusiveness was driven by the discovery that you were still in contact with your now-current sweetheart. If this is correct, then closely timed K-1 applications and volatile women are the least of your problems.

I hope everyone else will forgive me for this...

Mr frog, so sorry for your failed relationship. It happens sometimes, but if someone just got done kicking me below the belt, I would take sometime out to heal. Whats the rush to get kicked again, not saying you are, but you are acting to fast with these woman. My advise is to take sometime and get to know the woman good before marring. Ive been with my woman for over two years and i feel so much better and comfortable with my deceision on marriage. Anyway im not here to down you but just want you to think about what your next move. Good luck with whatever you decision is. Peace out :thumbs:

Thank you for the advice on waiting. Please don't get me wrong, I appreciate it.

The advice I asked for is to find out WHO to contact, HOW to contact them to clear up my connection with the USCIS for the failed relationship.

I think I cleared up everyones question that I am NOT filing TODAY.

I'm not rushing to get kicked again, but I am rushing to clear up my connections with this woman in the eyes of USCIS.

I am not rushing with any woman/women.

As for my Next Move and current goal... It is to clear up my connection with the USCIS for the failed relationship. My current project is not filing K-1... as most here thought before I clearified...

My question I wish everyone would focus on has been answered by some great members. I am SO THANKFUL for the few members that gave me the Info I needed.

That is my reason for being here... to find out WHO to contact, HOW to contact them... so that I can get that part taken care of.

what he should include... so here it goes

FROG include as much information as you can as to why your relationship didn't work out with your former fiance, as you have plenty. Make sure you include that you did know your current fiance even before you met your former fiance.

what you shouldn't rush into is sending the petition right away. Take PLENTY of time into reviewing whether everything is complete, and think like a USCIS adjudicator and CO. Make sure to point out the smallest gaps... what I can think of on the top of my head right now is have you met within the 2 years and describe that relationship at that time (friendship type) and now it elevated to something mature and serious. Write up an affidavit describing the relationship with your current fiance at different time periods. In other words, just let it all out and be truthful..and nothing will go wrong ok?

And from what I'm familiar with, most embassies are different, some are strict and some are not. Just remember, once it reaches the US embassy, you are not the applicant, your fiancee is... so you will not be questioned here, your fiancee will. And of course a question will be asked of your fiancee during the interview regarding your past, just so the CO knows your fiancee is well aware of your former relationship

no offense but i doubt these are bonafide relationships, as posters above stated. how do you think your process will go when all this comes out at USCIS or consulate ? you may be setting yourself up for a 3rd K1 couple years down the road.

i have a Chinese fiance, i have been to China several times and have had a long distance relationship when not there for about 2 years. lately i am having trouble because i got hit by the economy, my overtime got cut, i make much less money then i used to and i havent been able to return to China since october last year :( so it is taking a toll on our relationship and really we are going through the test of time.

i have met my fiances family, except her father and brother because they live in part of the country that i have not been to yet, but i know all her bad sides, mood swings etc. it is very important you do not choose to marry a person that you can not live with, and to see if that is or is not the case you need time.

as posters above said, give it time, take it easy, go for some local dating for at least 6 months or a year, or just concentrate on yourself, start working out, get your finances in order etc. then date internationally again, but this time, really date.

I would advise the samething... but from my understanding FROG knows this person for quiet a while, he hasn't met her right after.

However, FROG if that is the case that you just met her, give it a few months and then go with your intuition that is based on some grounds.

Thank you Hopeful... first for taking the time to read enough to understand what I'm asking for and second for sticking to the request, and third for not reading too deep into my mind.

I am wanting to do what you have mentioned, and I am trying to determine is if I should just submit the affidavit/police report/photos/ etc. right now and try to clear up that filing and answer any possible questions that surface... I still need to get the other items together mentioned by

You will need to file the waiver letter. Nothing else except what you already did with the first petition.

You simply need to write a letter (not notarized) requesting a waiver under IMBRA and giving some proof of what happened to #1. The USCIS will not blink at approving your petition, if the waiver request accompanies it, and unless you can't give evidence that you two have met within the last two years. THEN it will be up to USEM to ask all the tough questions about your romance, i.e., if it is bona fide, etc. That's where it will be a bit sticky, perhaps.

I think this is all you need to know. As to your choice of partner, think about the lesson you should have learned and then act.

You submit a request for a waiver under the IMBRA as a simple 2-paragraph letter to USCIS, with whatever proof you offer stapled to it, accompanying your petition. It's just part of the I-129f package, and won't slow down the processing. Don't ask why....it's their regulation based on the fact that ordinarily, one can submit no more than one petition in a two-year period. You are asking them to waive that 2-year guideline.

You dealt with IMBRA on your previous K1 petition (we all did).

I think it is best to clear this up before I submit the 2nd K-1 verses submitting it later "with" the 2nd K-1 so that it may help in healing during the span of time that elapses. Even though we have meet before and have a solid foundation, we do have ground to make up before filing and it will be easier if I put this to rest ASAP. I know they will discuss this with her at her interview when that time arrives.
