My husband and I have not used a lawyer for the AOS process. But, we have a freind that is an attorney and has offered to go to the interview with us. Does anyone advise against this or for this? Can you all share your opinions?

We took an attorny to our interview. Basically he just sat there and was quiet. It was good for moral support, but otherwise useless.

No need. We never used a lawyer, and so did not take an attorney to the interview. Our interview was routine and painless.

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

I am taking an attorney to my interview, which is this friday btw =), and I agree with Chris39, the main advantage to it is the moral support and security they offer. Specially if you're a nervous person, it feels good to know that there is someone there who hopefully know more about immigration laws than you and can help you out if its neccessary. Also, I live in miami, and there are a high rate of fraud cases here, so some IO can get very agrressive, and an immigration lawyer can help control the situation if needed.

The OP has a friend who is an attorney, so this is not an attorney who is familiar with the details of their case necessarily (and did not file their paperwork). This is also likely not an immigration lawyer, so he likely does not know more about immigration law than anyone else. The interview is more about proving that a bona fide marriage exists, not a trial or hearing where complex legal matters usually come up. Even an aggressive interviewer would likely try to trip you up about your relationship, not pull legal technicalities. Moral support from a friend is all they would likely get here.

I apologized, i assumed that the attorney was an immigration attorney. My attorney didn't file my paperwork either because i thought that was a waste of money. I still think is good to take an immigration attorney to the interview because at least they have the experience and know what to expect. This is just my opinion, of course.

Well he is a Corporate lawyer for large companies. He does immigration to bring employees to the U.S. for these companies.

Having him there is not going to endanger your petition in any way, so the real question is....do you want him there, and will it make you feel more confortable?

I appreciate everyone's innput. All of this can wear on my rationale. You guys are wonderful.

Bring a potted plant instead. It is YOUR interview, they have no questions for an attorney.

Which has nothing to do with a K-1/K-2 visa where it is only necessary to show a legitimate relationship is present. He never does that for employees.

The IO will have no questions for him and there is nothing he can "object to", they can ask anything they want because you have no "right" to a K-1/K-2 visa and no "right" to an AOS. It is YOUR obligation to demonstrate to the satisfaction of the IO that you have a legitimate marriage relationship that qualifies for this immigration benefit. Shouldn't be a problem if you do. We had no questions asked and were in and out of the building (including wait time) in 13 minutes. If he makes you feel better, bring him along. Unless he is entered as your attorney of record (filed G-28 with USCIS) they do not even have to let him in the interview room, for that matter they do not have to allow your husband in the interview room, but they usually do.

At our interview the IO told us that we were already approved before we even sat down in front of him. The interview took 8 minutes and that included us asking him if he would like to see our wedding photos since we had brought a lot of evidence along. It seems they may already have a good idea of approving or denying before you even get to the interview. Unless the attorney has been with your case from the start...I don't see how IO would even pay much attention to them.
