Thinking of possible way my husband can stay til i get my visa approved

Thinking of possible way on how my husband cn stay here with me til i get my visa approved when we file it by this november or december jst getting ready for all docs and expenses. He is 10 months staying wth me here in the philippines he is american. He filed a permanent residency here in teh philippines under probationary period he was give 1 year. He has a medical issue had spinal cord injury and was assisted by a helper thru a wheel chair in terminal 2 when he arrived. he can walk but can't stand it the whole day he gets tired back hurts. He wants me to go with me to be with him when returning to his homeland in Alabama USA. We don't know what to tell or how to tell the USE manila so he can stay with me til i get my visa and fly together. We will live in the house of his mom. He is stil paying ONLINE his medical insurance , life insurance, credit card, tax, and many others in the USA . he has a bank account there bcoz thats where he wants us to live permanently.Although he did not renew his driver's license that was sent to him 2 mths agao bcoz we will go there again and by yhe time it is expired again so he can jst clear it when he go back there. But i have read in the USE Manila website that the petitioner has to return home to face/prove his domicile. And read some of the experiences of those who was already interviewed that the CO told them that good thing their husband is in the US bcoz if with them here they cannot give them a visa for the reason it is given to reunite.

Please anybody has done DCF in USE Manila with their husband staying till they get approved ..pls share what and how to do it possible way. bcoz we will really live in the US and medicines here for him is very expensive while in the US he can use his medical insurance and can buy those meds in very chaep price and doctor with zero co pay. pls help!!!!! :help:

You and your husband better be careful, because the personnel at the USEM get sight of you (if I remember correctly you are much younger than the USC) and him in a wheelchair and they just might think he is importing a nurse even if you have no nursing skills.

I am 36 and my husband is 40.....just small tahst why look young...hehehe

He can walk , he just got so tired form his flight from alabam to manila philippines with stop over. Imagine that he has a back injury and was able to fly for me prove that he really loves me. So what u mean is its not a good idea to say that and emphasize that so much on the USE manila bcoz they might think we are using his medical conditions to geth tehre even though he really has. He is good although cannot stand a whole day walking and getting tired. Thats why he has to come back to the USA where his very good doctor is. but he wants with me. Also being practical air ticket is so expensive. Thanks for ur concern! we will also talk abt this to USE what is the best thing to do. Although he can fly gain by himself as he said but he prefer to be with me as much as possible.

I wasn't saying what is in bold above. I was saying that if USEM personnel see him in a wheelchair, they might think he is importing a cheap nurse (that would be you even if you have not nursing experience), they might think that he doesn't really love you, but instead wants someone to help him since he does not get around very well.

It is risky to let them see him in a wheelchair in the USEM with you assisting him. It just doesn't look right. Actually, it looks perfectly normal, but unfortunately, not normal in this context. This is my opinion, others might disagree, no one really knows, but better play it safe than to be accused of something later.

Hi Navywife, we have almost the identical situation, I came here to live with my wife only for the 6 month requirement in order to file for the DCF. I also am disabled but my wife is much younger then me. we have been married almost two years now and plan a DCf in november. please let us know if you have difficulties and we will do the same, any comments are welcome

Yes we are palnning to start filing before end of this year by God's grace. We are going to the Immigration by netx friday to have my husband's passport stamped for his application of permanent residency. To be able to file a DCF you should have a Permanent Residency application here in the philippines. We are going to also frop by at the USE Manila to get form 1-130 and ask the necessary requirements much better to gather all the docs to be needed ahead of time.

Sure once we have filed it we are going to infor u guys. Just making ready and we are starting to save before we do it.

But they required my husband to re establish his domicile before i face the CO for interview and be given a visa is what it is said thru the email that i sent them.

Do u also plan to stay here with ur wife til she gets her visa approved? :)

Ok thanks for your suggestions i appreciate it! My husband is not in a wheelchair all the time ....that only happened once when he arrived at the airport he cant stand it he was so tired from the long flight knowing he has a back injury. Thank God he can walk but always bringing his cane with him.

Hi Navyswife well i did plan to try and stay until she recieved her visa but i e-maild the consulate and they replied that i would have to return to the US before she recieved a visa, btw you don't actually need a permanent resident visa here in the Philippines, with a balikbayan visa you can voluntary apply and recieve a ACR card by applying at the Manila BPI only ;)

Hi Navyswife well i did plan to try and stay until she recieved her visa but i e-maild the consulate and they replied that i would have to return to the US before she recieved a visa, btw you don't actually need a permanent resident visa here in the Philippines, with a balikbayan visa you can voluntary apply and recieve a ACR card by applying at the Manila BPI only ;)

Yes but they said in the BI Manila that balikbayan visa is only good for 1 yr unlike when u applied for a PR after 1 yr they will renew it to 5 yrs.But then if u only want to qualify to apply a DCF that is just fine :) Yes ur right its like 50/50 when USC will not return to the US to prove his domicile. i knew some who was interviewed by the Co and said that good thing the USC is in the US bcoz if not they cant give her a visa bcoz the reason is to reunite...So my husband also will have to comeback before i face the CO after we file a DCF before end of thi year....goodluck to both of us! ;)

so are you suggesting that age differance and disability disqualifies someone for a visa ? this is a visa, consular, and laws of the United States of America not the Philippines, it is illegal to discriminate on the basis of color creed religion disability age or gender that applies to any and all government or public decision makers please do your research before saying such silly things
