My fiance recieved a letter from the American embassy stating his petition was approved (this was after the NOA2 ofcourse) and was given a list to have ready. They have also requested some forms to be filled out and sent back to them.

The problem is that his passport is wtih the UK govt as his visa for uk is geting extended. There is no word on when he will get back they said it could take upto 12 or 14weeks or longer. its been about 8 weeks i believe and still no sight of that passport...

so does anyone know when we have to return the forms to the american embassy? does it really have to be ASAP...

it seems as though we have to wait for his passport any one know a way around this?

Once you send in the Packet 3 forms, it typically takes at least 4 weeks before you receive Packet 4 which assigns the interview date.

Also, you can enclose a cover letter requesting an interview date after a particular date. London tends to be very good about honoring these requests.

Finally, you can hold Packet 3 for a few months. The NOA2 validity period is 4 months, but the embassy will often automatically extend that, so if you hold off on returning P3 for a few more weeks, you will be fine.

And you don't need the passport for sending back P3. You need it at the interview. And even then, you could attend the interview and explain the situation about why it is not in your possession. As long as everything else is in order, they'll approve the visa pending receipt of the passport, which can be sent to the embassy via SMS.

The forms and the checklist can be sent separately.

As Julez points out, you can drag out packet 3, but I wouldn't count on them automatically extending your petition approval validity without any contact from you.

Sending in your forms will keep your case active, but it isn't until you send in the checklist that the trigger for assigning an interview date is activated. When you send in your forms (closer to the expiration of the NOA2), include a cover letter requesting an extension on the NOA2. They may do it automatically, but just to be sure.

Your case sounds a lot like MARM's, and in hind sight, I think that holding the checklist until after the passport was in her fiance's hands would have saved them quite a bit of stress. Don't believe any processing dates the UK home office gives you, just like the US system, it takes as long as it takes, and you can't do much about it.

If, after the extension, you still don't have the passport and the extension is about to expire, call the extortion line and ask them to extend it again. They may give you the email code, or maybe they can extend it for you.

December 23, 2009: NOA1!

we asked the embassy and they told us we have 12 months from the date we received our NOA2 before sending the checklist back.
