Hi,

I just got engaged last week and my fiance and I are asessing our visa options. We are thinking about going the k-3 route. I'm in the U.S on a J-1 visa and leave in 5 weeks. We were thinking of getting married here quickly in a courthouse before I leave for Ireland and then applying for the k-3 visa. My reservations were that we might have enough evidence to support the marriage since we would be having such a quick ceremony and that our engagement would be so short. I just didn't want to leave a bad impression and have a possiblity of not getting the k-3 due to lack of evidence for the marriage. Our full wedding would be next May. Our other option was to do the fiance visa and get married next May. We just are enquiring if the k-3 would be a better option for us.

Any help would be much appreciated

Reading the guides would be an excellent place to start to figure out what visa is for you.

J-1 visas sometimes have a 2 year residency requirement, does yours? That is one thing you will need to figure out.

You can do the k-3 but it is a virtually obsolete visa where the costs out weight the benefits you best to look into a CR-1 if you decide to get married.

The CR-1 spousal visa would be fine for you (forget the K3). They know that people married and living apart won't have much evidence of bonafide marriage such as bills etc, but you can show other stuff, such as photos of you two together both before and after the wedding (ideally with eachother's families), hotel receipts of when you stayed together, affidavits from family members and friends who know both of you and how in love you are etc. As you are from Ireland (me too!), you should also be able to go visit him during the proccess- or he you- and gather more evidence and photos then.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree that CR-1 could work for you definitely, but have you thought of just getting married and staying here while you process an Adjustment of Status? Someone else would know better than I do if this will work for your J-1 visa. I would at least check into it. That way you could go through the process together, rather than spending a year apart while your CR-1 is being processed.

Looks like you may need to keep your J-1 status while your AOS was pending... maybe that won't work for you... anyway, just a thought. Good luck! :)

Also, regarding the K-1 visa, you could do it, and the timing would be right for May. My Irish husband and I filed his K-1 on Sep. 8, 2008 and he was approved in March 2009. And he didn't exactly rush to get everything done, so it's definitely an option for you as well.

My J-1 is only a four month work and travel so I have to leave anyways and I've a year to go in university back in ireland so my fiance and i will be apart anyways as she is working here. I'll look into the CR-1

The length of your stay here doesn't matter, it's how long you are in Ireland afterwards. Something to look into before you file, just in case yours is one of the ones affected...
