On July 17, 2009, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail.

aug 3 and still no letter in the mail. what should we do , wait or phone ?

If I'm not mistaken, doesn't it say they can take up to 60 days to make a decision after they get the info back?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yup.. Thats after he responds, but he does not have the hard copy of the RFE that he needs to respond to and include in the response... Roger made a good point about possible different address... I have seen lags in delivery of hard copy and email but not more than a few weeks...

If I'm not mistaken, doesn't it say they can take up to 60 days to make a decision after they get the info back?

the thing is that we haven't recevied the letter yet that they sent in the first place, I just got that notice in my email on the 17th , nothing since

she moved but had the address forwarded to the new place so that all mail sent to the old place would be sent to the new house, then last week she changed the address online to the new address.Today she got the notice in the mail of change of address.

it can take some time for forwarded mail to get there and the RFE may be a "do not forward" parcel. In that case it would be returned undeliverable... As I said earlier.. if it isn't there this week.. call...

Mail forwarding can really slow things down. Did you say that she just set it up to forward last week? As in there was a lapse in the time between time that she moved and the time that she got her mail forwarded. It's possible that it is either sitting in the mailbox at her old adress or has been marked return to sender by the new mailbox owner, or they might even have thrown it out. Might be an idea to contact the person living at her old adress and ask if they've received any mail for her. If I'm understanding correctly that there was a period of time when she did not have her mail forwarded and did not have access to the box.
