Timeline

Paperwork for son's application Cr-1

I have ful custody and currently in court for the ability to move him to the states should be done in the next few months,

Now I have paperwork stating I have full custody etc but do i need to send this with the i-130 or can i wait to send this in till i have the other paperwork court stuff as well?

Even with custody papers etc, I beleive when you case gets to the NVC level they will still need a current notorized document from the other parenting allowing the child to immigrate to the US. You will need to check on what the exit requirements are for your country also.

No you do nto need to send with the I-130.

Im from ontario, canada.

His father has visitation and that is it, which he hasn't/doesn't used.

As I have said I have all the paperwork I can have for right now, I have full custody and am currently going to court to move my son.

I don't want to just sit around and wait to start the process, I'd rather or i'd like to be able to start it and then submit the "court order to move" once i get it.

If you are going for the CR Visa whether you show the custody paers or not the NVC will still ask for the letter from the other parent listed on the BC. They never even asked us for any custody papers ( 2 step sons ) just the RFE for this notorized document allowing the children to immigrate to the US. However there was another case where they had the custody document however NVC still asked for the letter from the other parent.

Im not sure how that will work as I am currently taking him to court FOR the ability to move him as in he WONT agree to the move. So I am getting it Court ordered To be allowed. Kinda need someones input haha

That is why I provided the link, However maybe that order will work. The problem is that particular fact as far as the custody letter is not listed ANYWHERE on NVC papers etc. I know of it becasue in Dec of 07 our RFE from the NVC was for this letter. If I see something else I will link it up for you.

Please submit evidence that you have been granted custody of this

child. Copies of original court custody documents are acceptable.

In addition to the above, in cases of joint custody or remaining

rights of a non-custodial parent, applicants must also submit a

notarized statement from the non-custodial parent granting

permission for the child to immigrate to the U.S.

No interview will be scheduled until ALL of the information requested has been returned to the National

Visa Center.

Custody and permission documentation is not needed with the petition filing. It's needed later. A son (step-son of a USC) would receive a CR2 or IR2 visa.

Facts are cheap...knowing how to use them is precious...
