im sure these questions have been asked, but

when filing for AOS from visitor visa..

i see that the foreign spouse's bc is needed for the I485 altho u can use the passport "in lieu of" for the I130..

we do not have the BC and may have trouble getting it with mail time.. we would like to file asap, any suggestions? can the passport be used here also or should we just wait for RFE?

will we maybe just be asked to provide it for the interview?

i see this is required for the I485, if there are no available appts in the near future (next 2 weeks) is that something else that can be offered at interview?

09/03/09 Completed medical.. all clear!!

09/21/09 Sent off I130, I485, I131, I765.. YAYYYYYY[/color]

09/23/09 package received

09/28/2009 all 4 NOA's printed (received on OCT 1ST)

09/30/09 checks cashed!

10/05/09 receive biometrics appt for 10/28/2009

10/13/09 walk in biometrics.. !

10/26/2009 receive interview letter for NOV 30th 11:30!!!! PRAISE GOD!

11/06/2009 receive advance parole papers.. no email, no updates beforehand..

11/16/2009 After 2 WEEKS of checking the mail thinking the EAD and AP come about the same time, we get the "card production ordered" email for the EAD.. better late than never.. thank you LORD!!!

11/19/2009 receive another email stating "card production ordered"

11/23/2009 receive EAD!!!!!!!!!!!!!!!!!!!!

11/30/2009 bittersweet interview, but WE ARE APPROVED

12/02/09 social security card in mail

12/04/09 receive "welcome" letter in mail

You need to submit copies of Birth Cert. with I-130 & I-485 alongwith translations if in a foreign language. I did not have a Birth Cert. and submitted a copy of Registration Form from our Country which is recognized as proof of Birth Date. The IO accepted it and knew that in our part of the world, most Birth Cert. were fakely produced since Birth records were rarely recorded in the 80's and before.

Medical is initial evidence and its best you attach it along with your AOS application rather than delaying your case un-necessarily. For your USC spouse, his/her naturalization certificate/passport will be enough as proof of Birth Date.

For your last sentence, I didn't quite follow you. Your AOS application will take somewhere from 4 months to 1 year.

on the I130, the guides say that the bc OR passport but u are saying the will need the BC definately? ok..

so becuz we were not prepared we will have to send off for this and the mailing i've heard could take several weeks, can this form just be offered at the interview?? or will we most likely be RFE'd?

on my second question.. i am calling around and looks like an appt for the medical could be another 2 weeks or so.. could i submit the I485 W/OUT it to save time for the EAD filing (could i just be RFE'd for later or provide medical later at interview) or should i just wait until after the medical is done and submit the medical w/ everything else.

Hi. You will get RFE'd for both absence of the birth certificate and medical exam, since it is REQUIRED INITIAL EVIDENCE. Your process won't continue until you send it in, so I suggest to wait and get this stuff done, and then send it. Good luck!

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

You should just concentrate on having everything BEFORE you send it in. It will look much better to have everything sent in correctly the FIRST time and not get any RFE's. RFE's slow down your process, probably moreso than getting everything together beforehand. I can't stress enough the importance of having everything right from the beginning. It really pays to be prepared.

Thanks u guys!!! i will definately wait and do everything together.. Looks like getting the BC will not be as hard as i thought and we will just get all this paperwork together while we wait on the medical..
