actually HE"S been deported 5 times!

You will definitely need a waiver, since the visa will be denied. Now, an important question: those times he came in... did he enter without inspection? or did he enter on a tourist visa and stayed? That will make a huge difference in whether he will ever be allowed back in.

he came in threw the river! the rio grand, not threw inspection

Oh, and a little aside comment... don't expect people to give him a round of applause for that.

I wish you the best of luck; but prepare yourself for a long, tedious, and extremely expensive process. You might want to consider moving to Mexico.

yea i know, he doesnt deserve a round of applause, but oh well what can i do, im the one that feel in love with him now!

trust me thats my last opption in moving into mexico! but i do counsider it an opption i might have to take.

Absolutely --- he has accumulated five deportations, so you can count on that, and on the need for waiver and definitely for an experienced immigration attorney.

Yes, his visa will be denied. You will have to file a 212 to overcome the deportation and an I-601 for the accumulated illegal presence. A lawyer will be able to help you with how long of a ban he has and when the waiver will be available to him (with him being caught 5 times, you have a tricky case).

For the waiver, you will have to show why you cannot move to Mexico and why you will suffer extreme hardship if he is not reunited in the US with you.

he never came in the us with his mexican visa, he always came in crossing the rio grand! And everytime he was cought by a police man and they would just put it in his record that he has been in the US illigaly but never marked as a felony. Out of the 5 times he was cought, they just put it on his record and returned him to mexico. But the last one he went to jail for 6 months, and they told him that if he re enterd the country illigaly that they would mark it as a felony! he hasent come in ever since! its been about 3 years since that!

Big question. After his first illegal entry, how long did he stay in the US? If he entered illegally, stayed for more than a year and entered illegally again, he is subject to 212(a)(9)©, which makes him ineligible for a waiver for 10 years. It's not the number of illegal entries that is the problem, it is the cumulative total of time spent here illegally. Once this total reaches more than one year and you enter illegally again, 9C kicks in and there is a 10 year bar with no possibility of a waiver.
