Question about my petition on my stepson

I filed for my stepson last april 1 2009

and we receive the noa1 last april 29 2009

until now we are waiting for the noa2

is it normal almost 4 mos we dont receive our noa2?

when my stepson arrived here in US what his status green card holder or Us Citizen?

he is only 16 now we expect him to be 17 when he arrived here

Timeline

Proccessing times are anywhere from 4-6 months for the NOA2. When you step son arrives he will be An Permanent resident ( green card holder ) , depending on how long you have been married to his mom he will get the 2 year card ( married less that 2 years ) or the 10 year card ( married over 2 years )

Why is it that the only one who can stop the crying is the one who started it in the first place?

9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well

Yes its normal to wait 4 months for I-130 approval. Normal processing time is 6 months. Your stepson will be a greencard holder once he arrives. If he had a claim to US Citizenship then you would not be filing a I-130 for him.

i heard it from my friends that if my stepson arrives here before he turns 18 he will be automatic citizen is that true?

That is False. He will have to wait until he has been a LRP for 5 years and apply for citizenship. Had he been younger then it would have been a differnt case if his mother Naturalizes then he would have that benefit. :)

If you filed the I130 then your stepson will enter as a LPR. Stepchild do not get citizenship from stepparent, as in my case. If his biological parent is a US citizen, then even if he enter under your petition he will automatically be US Citizen. I petitioned for my stepsons in January this year, in April their father got his citizenship, upon entry into the US my stepson was granted citizenship because their father was a citizen at that time. We now apply for US passport for them and they have only been here 2 weeks, we have not received greencards yet. It doesn't matter how long you are married to the biological parent, they child will get 10 year greencard if other parent is not citizen.

Your step son's status will be LPR and will have the green card NOT US citizen.Green card will depend on how long you been married to your step son's mother.. 10 yrs. if you are married to her for more than 2 yrs. and 2 yrs. conditional if less than 2 yrs. married.

Because my step daughter was under the age of 21 and unmarried, I could petition for her, but could not do that for her older brother that was over 21. Only his mother, now a USC can petition for him with a rather long wait.

As I was married to my step daughters' mother for less than two years, step daughter did receive a conditional card, but certainly not immediately, took the USCIS over nine months to process our case. But my step daughter was able to tail gate her mom on the I-751 with me only paying 80 bucks extra for her biometrics.

So here we have major restrictions if a child is over 21, but not true with the N-400, that 21 age limit is reduced to 18, as our daughter just turn 18 before we could apply due to the delayed processing of the AOS, not only have to wait the full five years for her, but have to pay the full fee of around 670 bucks for her.

When I read these regulations, scratch my head and wonder who writes them. Any parent that has kids, have kids for their lifetime, if you kid is over 21 and sent to Iraq, that doesn't mean you stop worrying about them, feel the USCIS is crazy on their regulations. And since my step-son is over 21, I don't even have a say in his petition, if we can get him here, will be staying in my home.

Even with our IRS and health insurance regulations, a kid is a kid until the age of 25 and can be included as a deduction and fully covered, so where does the USCIS come up with their rules? With our present economy, takes that long for a kid to get an education.

I would be absolutely pleased if someone would tell me that I am misreading the instructions, I did check with my immigration attorney, and he said I was reading them correctly.

Yes Nick you read them correctly as I have the same problem with my oldest step son :D

Question the USCIS about their regulations, they claim they are only doing their job, congress makes all the laws. Question your senator or congressman about these laws, they claim they are too busy with Iraq, economy, or heathcare, and know nothing about the zillions of agency laws, say they make up their own laws. So you go around in circles. Thought our laws were made by and for the people, really, the only thing congress does is to create these governmental agencies, like 1,525 of them, mostly in the last 40 years.

Ombudsman is suppose to be a watchdog for the USCIS, about as effective as getting a goldfish as a watchdog, complete waste of your time. But not only the USCIS, but the DOS also gets in the act, that's two agencies to deal with. More than one guy can handle.
