My stepson has recieved his appointment date via e-mail. My wife and I have been married for almost 5 years. She was living in Hong Kong when we met. At the time she had been seperated from her husband for 5 years and her children were in the care of her then sister in-law. while in Hong Kong she filed for divorce ( no divorce in Phil). In the divorce there was no mention of custodyof the children. Her daughter married an American under a k-1 visa Jan this year. But 04/10/2008 we had filed I-130 for her son who will be 18 this nov 30. When we recieved the interview notice they requested custody papers to be presented at the time of the interview. They had requested these when they sent us a email requesting additional infomation before we recieved the interview date. When we got that we called NVC and we were told to have my stepson's father write a letter giving permmision for his son to immigrate to the U.S. and have it notirized and send that in. We don't know what to do now. Because there are no custody papers on the children. Please Help us. P.S. as petitioner do I need to be at the interview my wife is flying back to manila for that. and will the embassy set the appiontment for the medical or does my stepson just show up at ST Lukes with appointment letter in hand thanks for any help

Your step-son would not need his father's permission if he is 18. Perhaps, you or your step-son can asked that his interview be postponed until after Nov. 30th. If he interviews before Nov. 30th, he will need his father's permission to immigrate as he will still be a minor.

I don't believe that you or your wife can be at the interview. Call the US Embassy in Manila to check.

Your step-son would not need his father's permission if he is 18. Perhaps, you or your step-son can asked that his interview be postponed until after Nov. 30th. If he interviews before Nov. 30th, he will need his father's permission to immigrate as he will still be a minor.

I don't believe that you or your wife can be at the interview. Call the US Embassy in Manila to check.

I understand but he does have his fathers permission to immigrate he sigined a notirized letter saying so. what Iam worried about it there is no custody papers during the divorce

It is unusual for USEM to ask for this kind of information, they let many women leave the Philippines with young children everyday without any evidence that dad knows they are leaving. I'm actually amazed that they allow this, but they really do. I wonder how many dads have lost kids to the US.... has to be lots.

hi there. i'm just curious...were your wife and her ex married in the philippines or in hongkong? if in phils, are you sure it was a divorce or a legal separation that they got, in which case, maybe at the time the "automatic" (mother gets custody of all children 7 yrs and younger) custody of your wife over their children was applied.

i dont think Manila US embassy is allowing mother to take their minor kids abroad without the knowledge of the father.... i dont think so... i brought my son ( 5 months old ) to the US and asked for a notarized letter from the husband stating that he is aware that im taking our son with me... and that he is allowing me to do so.... to note that my husband was with me in the embassy while i was trying to process my son's visa, he was in the embassy!!!

US embassy is smarter than that i think..... they are always after to the child's safety!!!

but then, if the child is over 18... then im guessing thats when you dont need the father's permission!

They dont let any woman leave Philippines without the father's knowledge... i have to say that! they dont!!!!

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!

I doubt that the US issues immigrations visas to young children so their moms can take them out of the Philippines "without any evidence that dad knows that they are leaving." What the mom doing is called kidnapping (yes, you can kidnap your own child if you are taking the child out of the country without the other parent's permission). I doubt the US is going to allow this. I doubt the Filipino government would allow the US to do this. Imagine the number of angry fathers that would result if mom took the kids out of the country without his permission.

1. No you do not need permission from the biological father even he is in the birth certificate of your kids. Requirements for minors travelling abroad is one biological parent and birth certificate of the kids. No DSWD clearance needed either.

I just want my daughter for her last name to be changed to her stepdad, my husband . I've been there, done that. Just read my answer to your number 1 question. My ex-husband is very much alive. He does not know that my daughter and I were leaving the country last year. I do not have full custody of my daughter either and she is using his last name in all her documents, passport, visa, CFO and ticket. He lives 20 minutes from us. Our marriage was annulled. Then I married a US citizen. Do not worry too much. You can search here in VJ my old post about the 2005 change in guidelines for minors travelling abroad. We are in the US for a year now. My daughter have adjusted well and what she wants is just to change her last name so that it will be the same as her baby brother.

This was what happened, when we paid the travel tax, the immigration employee at NAIA just looked at my daughter's passport and her birth certificate. She saw that I am the mother and then she let us through to board the plane. No questions asked.
