I'll try to start on a more detailed timeline later, but for now this is what I've got.

I'm absolutely confuzzled with all the documents necessary for all of this and I just got sticker shock looking at the prices for the I-485.

I met my fiance' in June. She is here on a J-1 visa that expires soon (August 31). We plan to marry August 19th and file the I-130. We are prepared for the I-130's costs but got stickershock at the $1,010 for the I-485.

Background info: Fiance has Russian nationality but is a lifelong residence of Uzbekistan so her passport shows Russian Nationality on one page and Uzbekistan Nationality on another page. She has a social security card that states "...approved for...DHS authroized only..."

Questions:

1) Will her status be in jeopardy if we are sending the I-130 packet 12 days before the end of her authroized status? (Note: I understand that J-1 visa holders have 30 days after expiration to return to their home country).

2) Do we have to file the I-485 with the I-130?

3) If she is a J-1 holder under a work exchange program, is she eligible for the I-765? If eligible, is approval likely?

We want to do everything legal, but after speaking with the attorneys in our area, none seem up-to-date on the J-1 visa information.

1) no, but just as an FYI, some J-1 visa holders are subject to a 2 yr home residency requirement.... on what basis was the J-1 issued

2) no, but it is the I-485 that protects her status after her current status expires not the I-130

3) depends.... 2 yr HRR?

YMMV

#######. Thought I put that in there...

Passport Visa says "Two year rule does not apply (Uzbekistan)."

I have another question but it wouldn't let me amend to it:

"4) The I-765 and I-131 are optional. If she wants to work, should we file the I-765 with the I-130 or seperate (later)? If she wants to go home to see her family later (6 months or so), should we go ahead and do the I-131 now or should we wait until later in case we don't need it? Or will she need it eventaully if she wants to travel anyway?"
