Affidavit of Support I 864 / no 2008 taxes

Timeline

Ok I just recieved a notice that my wife's petetion for the K3 visa was approved. She will now have the interview at the embassy. My question is what do I need to show to prove that I can support her. I lived in Peru all of 2008, so I wouldnt have filed any taxes for last year. I did file for 2007, 2006, and so on. I made well over the poverty line requirements. But I just dont have the tax forms from last year. How bad will that look?

Send a letter of explanation why no taxes was filed for 2008.

If possible, give a copy of your entry and exit in Peru (stamp on your passport) to your wife so she can present them as evidence.

If you worked in Peru, maybe you can ask your boss there to write a letter or notarized document stating that

you were employed there for a year.

If you have assets, send proof to your wife for evidenciary purposes.

So what income are you using now? Do you have a job now in the US?

And second - why didn't you file taxes in 2008? Since you worked in Peru, usually you still need to file taxes for the US.

You will have to provide a written explanation why you didn't file taxes, and what laws allow you to do that. (check the instructions for the 864, they will be more clear)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
