Hello everyone!

Me and my fiancee has a question.

In the affidavit of support you have to state that you are capable of supporting the benificiary (kind of)

But how much do you have to earn? And is it based on yearly income or yearly income AFTER debts in short, what you bring in.

My fiancee is confused and so am i.

It is based on the number of people in your household. You must earn enough to support your household or you would need a co-sponsor. Look at the guidelines. Good luck on your journey.

Goes by annual income without counting living expenses. Google I-864P USCIS.

Well, what you have to make is the amount listed on the poverty guidelines. (Per year.) :-)

It is based on your Gross Income (which is before expenses etc.) :thumbs:

Use this list - USCIS poverty 2009

Depending where you live - household of two requires $18,212.00 minimum.

You count how many people are in the household (as per the documents) and then add you.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Scroll down, you will see a box that list the #s of familiy member and the $ amount you have to make annually NOT TO fall within the povery line. If you make more than that, you are assumed to be OK by Department of State and USCIS!

Sadly - USCIS uses the USCIS poverty level, not the United States Department of Health and Human Services Poverty level, which is listed on that wiki entry.

(State department also refers to the USCIS level)

The link I provided is right from the USCIS site, showing the USCIS level needed.

Debts are not considered. Only gross income (line 22 of the IRS 1040 form). The I-864P guides list the minimum income levels for various family sizes.
