Timeline

Hi,

I am here asking again for your advice. I am in a really bad situation.

I have applied for I-751 Petition for removing condition on February,09.

I received the NOA I-797C and I did the biometrics.

On July 18 we received the blue letter telling us that the documentation we sent was insufficient, the evidence is insufficient. And we have to the new evidence on or about August 23. We are planning to send back this week.

My boss just told me I have to travel overseas from August 14 to the 24.

I am terrified if something comes up wrong with my green card if they denied my second evidence

I am worry to leave the country because I don’t know if they‘ll let me enter again even though I have the NOA I-797C that say my residency have been extended for one year allowing me to travel and work for one year.

Any suggestions? What should I do? Should I wait to send my paperwork right before I have to travel, so I may not have an answer after I come back?

I would send in your paperwork as soon as possible. Usually after getting RFE answer, they either approve or if they call you for an interview, it will be at least 60-90 days in the future.

And as Haole suggested, go to an Infopass appointment and try to get a stamp in your passport, just to have peace of mind. They do honor the paper saying you have a one year extension, but passport stamp is always better. As long as you have the one year extension paper, they will legally allow you to re-enter USA. So PLEASE do NOT be terrified!

Timeline

Stamp in your passport does not guarantee that you will be allowed back to the US. Some radio host's wife got stuck in Philippines that way. She had the stamp, went to PI, while she was there, her I751 got denied and she was denied entry despite having a valid stamp.

Having said that, it takes some time to receive and process your response to RFE. You will be back in the US by the time they make decision on your case.

That wife got actually approved the one from Philipines.

I don't think that it is any more worrying to travel due to the RFE, then it was before the RFE. You'll only be gone for 10 days. Personally, I would send in the evidence ASAP with delivery confirmation so that you make sure that they get it, then go on your trip and try not to worry. The RFE shouldn't be any reason to deny you entry back into the US. I think it is a very slim chance that they will A> outright deny your application without an interview or a good reason and B> be able to process your information in that 10 day timeframe and send you notification of your denial.

But I do see that it could feel stressful. Hopefully all goes well and you will get an approval notice soon after your RFE response.
