Ok...i have filed the I-130 and see alot of those who are changing to a Cr1....my ?is....how do you change the process from a K3 to a Cr1 in thos begining stage of where im at...i have not recieved the 1st notice concerning the 130 i filed and if i want to change to a cr1 when and how do i do this...the guides are not too infomative to me and i just need some help in seeing how this is done...why it is done....and should we do this.....she is my wife from china and we have plenty of proof so im not concerned about that...or if i make enough money...my main concern is the changing of the visa we seek.....any info would be greatly welcomed...thanks...

If you submit the I-130 and only the I-130 then you will pursue the Cr-1. If you file the I-130 and the I-129F then you have the option of pursuing the K-3.

You can submit both the I-130 and I-129F now if you like then decide when they both get approved (generally on the same day) which path you'd like to follow.

In my opinion, the K-3 is twice as expensive and can delay your case. If you have just filed the I-130, stick with that and follow the Cr-1.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. Go for the CR-1. My kids I-30 and I-129F were approved on the same day, but the the I-130 never made it to the National Visa Center. They ended up with a K-3 visa. It has been complicated and more expensive than the process needed to be. Stick with the immigrant visa, unless you have compelling reasons to do otherwise.

Your question indicates you've failed to carefully study the appropriate VJ Guide for either CR1 or the obsolete K3 visa. Your success depends upon you doing so. I suggest you begin or begin again that study now, then return with remaining questions.

well i have been researching this for quite awhile now and have filed the 130...and does it matter if my wife from china doesnt want to be a u.s. citizen and keep her status as chinese....and im sorry to sound rude but people come here to get help...because we "HAVE" read the guides and still have no idea how to do this..we are not lawyers and are trusting people here to give us advice so we can gain some info on hte process and how we go about doing this...people like i do not need to be told to read the guides ...we have...and we are still confused...if somehas a question cant people just give them a answer....thanks anyways...and as for me...i did not fail ...its just a daunting task to do this and am just in need of some advice from people who have gone throught the process...later.

Thank you so much ...and so how do i let them know we are going to change the k-3 to a cr1...do i need to write a letter or something after i get the 130 noa or when do i let them know...only the money order has the info that we want a k3...just needing to know when i advise them i want to go woth the cr1....thanks

If you have JUST filed the I-130 then you do not need to do anything to follow the Cr-1 path, you are already on the CR-1 path.

Have you only filed the I-130? Did you submit the I-129F?

Having filed the I-130, you are on the CR1 visa path. Just don't file an I-129F and you'll never be on any K3 path to begin with. Your mistake is thinking you were ever on a K3 path. You're not, because you haven't followed the I-130 with the I-129F. Please go back to the CR1 guide and follow the steps outlined there. Simply forget about K3 altogether.

Apparently, you've read the K3 guide. You need to study the CR1 guide instead.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Chase is a USC by birth, He go his passport 6 week after his birth. Why would he need a I-130. OK now you have me worried !!!!
