New To Site, Help!!!!

Hello,

I'm new to the site so I'm not quite sure which discussion board I should be in. My husband is a US citizen and I came to the US when I was about 4 on a visa and stayed. Can anyone help me on which steps we need to take to file paperwork and what exactly we need to do first. Thank You.

Yes I was inspected at a point of entry. And my old passport has a I-94 visa attached, I dont know if that is significant.

what was your entry status?

probably does not make any difference but your status should be written on the I-94.... usually a letter and a number

Most likely your husband needs to file an I-130 petition ... and at the same time you submit the I-485 and if you want the I-765

The guides in these forums should provide you with a lot of good information. Since you entered the country legally and were 'inspected' (the I-94) even if you are now out of status, you are allowed to apply to adjust your status through your marriage to your US husband. He needs to file an I-130 petition and you would file the I-485 application along with the necessary supporting documentation (ie. Affidavit of Support, proof of marriage, etc.). You can also file for an Employment Authorization Document I-765 for permission to work, but you don't need to file for Advance Parole - I-131- which is permission to return to the US if you leave before your green card is approved. If you have been here since 4 years old it is most likely you are out of status and leaving would incur a ban on being allowed back into the US, probably a 10 year ban if you are more than 1 year out of status.

You may find it useful to consult with a knowledgeable and competent immigration lawyer who can review the circumstances of your entry visa and your situation to see if there are any potential problems, but based on what you have said here, you should be fine to adjust status through your husband.

You will need the I-94 to prove that you did indeed enter the country legally, so yes, don't lose it.
