Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

You may want to hire a lawyer.

Were your children in the US legally - meaning they had green cards? If you sent them to the US on tourist visas with the intention of them being here illegally may affect your petition as it shows a lack of regards for US immigration laws by you. If you assisted them in coming to the US and staying here illegally, you may be found to have assisted your children in committing immigration fraud.

Just because your children are able to enroll in school does not mean that their presence in the US is legal. Generally, schools do not check on the legal status of children. Even if your parents have legal guardianship of your children based on a court order or with your permission, it does not give them any legal rights to live in the US because they are Canadian citizens. Why should US taxpayers support the education of Canadian children?

Canadians do not need visas to enter the US as tourists or for business. However, they cannot live here which includes going to school.

So the question remains - were your children living in the US illegally, going to US schools illegally, and all of this was done with your blessing and by your design. If yes, then you have committed immigration fraud.

I hope that you don't take my comments as an attack on you. The issues that I have raised are going to be ones that the USCIS and US embassy/consulate will bring up in their determination to grant you an immigration visa. It's better to raise issues here so you can deal with them rather then rely on wishful thinking and having a negative determination. Once you get a negative determination that you committed immigration fraud, it will be impossible for you to get a US immigration visa. Better to deal with the issues now with a good immigration lawyer than not at all.

You need to find a good lawyer who can help you. If you choose to send your children to the US to live with their grandparents and go to school with the benefit of an immigration visa, you will be assisting them to commit immigration fraud. This may hurt your application for a visa, and I presume that visas for your children as well as they would be deriviative beneficiaries. Only a lawyer can help you navigate this. If I was in your position, I would not try to navigate the immigration laws on my own with assistance from an online forum. The risks are too high not to get a lawyer in your case.
