CR1 VISA expired

Hello everyone,

Last year I was granted CR1 VISA. The date was July 2008 and will expire December 2008. I entered United States last week of October 2008, when I was at the POE, they asked me the purpose of my travel and I said: " to visit my husband's family and friends, also to give my self leisure time...". I can't lie or say to be with my husband because my husband is in South Korea being an active US Army serviceman.

Now, my husband will be moving to North Carolina and I should be coming with him. Problem is my CR1 VISA was expired all ready. We did not do any adjustment of status. I also did not receive SSN even if I applied to give me automatic SSN.

His orders came short (not prepared) so this is really an urgent matter for us. He will be leaving Korea next week.

Please help me.

When u entered US ,did they stamp ur passport with I-551 (which is valid for 1 yr) ???Did u get ur greencard??

I think CR1 visa is only for single entry as you get a stamp on ur passport upon US arrival which u can use upto one yr for international travel n the green card ofcourse.

Did you enter on your CR-1? In other words, did they put an I-551 stamp, saying you were admitted for lawful permanent residence?

If so, you received green card status. You should have received a green card a few weeks after entry, delivered to the address in the US which you gave them.

The I-551 stamp is normally enough evidence to travel for a year, even if the visa itself is expired. The visa expiration date is merely the last date you can use the visa to enter the US for the first time. But after you use a CR-1 visa one time, you use your permanent resident STATUS to enter, so the visa expiration doesn't matter.

If you didn't get an I-551 stamp, then it sounds like they ignored your CR-1 and instead admitted you on some other basis.

Where are you located now? Where have you been residing since you were admitted? What are your dates of entry/leaving the US? I'm asking because I'm curious whether you've maintained your permanent resident status in the US.

Sorry forgot to include. I leave US November 2008 going back to my native country Philippines and since then I have not entered the US.

I just went to US for a month since my husband is in South Korea.

I did not have any stamp :(

No stamp. I leave the US a month after my entry. Just came there to visit my husband's family. After which. we did not do any adjustment.

I heard we can file even if it's too late (AOS) but have to explain why.

Is there any way I can go to US with expired CR1? Can army or any branch of army help me (like assistance?).

I am located in the Philippines now, we're married for more than 2 years now and we have not did AOS filing. Next week I might travel to South Korea but my husband will leave shortly to go North Carolina shortly after my arrival to Korea.

Well if you did not have a tourist (B1/B2) but only CR-1 visa when you got into the States then you were processed as a new resident. Go back to your passport and look at the visa page - what does it say and are there any stamps with a date on it - whatever kind of visa you had had to be stamped.

Well if you did not have a tourist (B1/B2) but only CR-1 visa when you got into the States then you were processed as a new resident. Go back to your passport and look at the visa page - what does it say and are there any stamps with a date on it - whatever kind of visa you had had to be stamped.

It just shows some Alien Resident # and stamp of my entry (date) but no stamp saying it's I-551.

Portland stamp the immigrant visa with a rubber stamp with the date and then either hand write CR1 or IR1 inside the stamp. I came in through Portland and just double checked my passport. Guess what they do is the same as every other POE

It will not be across the visa but just slightly overlapping one side of it.

It isnt the stamp that says I-551, its the visa. The stamp doesn't always overlap (my husband's didnt) but it was stamped on the page directly above his CR-1 visa. If you have a stamp overlapping or on the page directly above the visa, then you have permanent resident status.
