For the DS-156, question 36 "Has anyone ever filed an immigrant visa peition on your behalf?" - that doesn't include this one does it? I'm thinking no..but just wanted to make sure. I tried searching for this question but frankly the search engine on this website isn't the greatest one in the world.

also for question 33..do you intened to study in the U.S. - I mean evenutally he would like to go to school, but that's way ahead, so should I just put no for now?

May 2nd - Sent I-129F to Vermont

May 13th - NOA1

June 23rd - recieved RFE (IMBRA)

June 24th - Sent back RFE

June 27th - 7 touches

June 30th - touched

July 3rd - touched

July 10th - NOA2 notice via email

July 14th - NOA2 via snail mail

July 14th - petition mailed thru DHL to Asuncion, PY

Week of July 17th - Embassy received my petition

July 24th - beneficiary receives packet 3

July 27th - medical exam

Aug 7th - interview - approved :)

Aug 11th - picked up his visa

Aug 21st - purchased plane ticket!

Aug 30th - reunion day :)

I would agree with your assessment of how to answer the questions. Hopefully some other VJ'ers have some good input. Good luck with the interview!!

7-08-06 Stopped by Border Securtiy on NCIC name hit - Identity Theft two years ago and theif used my name as an alias which is now permanently tied to his criminal file as an alias - Border Security very helpful and understanding and apologetic about the situation but they have to verify I was not the perpetratpr.

7-10-06 Sent RFE

7-11-06 Received by CSC

7-19-06 Touched e-mail stating received 7-19-06 (BS)

8-03-06 Wondering ####### is taking so long - 128 days now

8-21-06 Congressional Inquiry

Why wouldn't it?

But think about it for a moment - DS-156 is the generic non-immigrant visa application. A 'yes' answer to this question could have some negative implications in most non-immigrant situations. But this is a K visa case. This question is not likely to be material to the case, unless perhaps whole bunch of people have previously submitted petitions for you.

My fiance' put yes for both. Since the DS 156 is generic, and ppl fill those out in relation to tourist visas that don't require petitions, I assumed it was better to say 'yes' and indicate that I filed for him.

For the other question regarding school: my fiance' out yes because he intends to enroll in an accredited English language course. But I don't think yes or no matters one way or another.

that's what you meant right? because i do believe that form will be needed for a k-visa applicant

We are wondering about question 36 as well. I'll be calling the embassy tonight to get a definite answer on that question.

About question 33, I spoke to the embassy about intent to study. According to them, a yes or no answer has no bearing on their decision. You can answer honestly (yes in your case) and maybe include a comment of "WITH APPROPRIATE AUTHORIZATION" modelled on VJ example 32.

as for both of those questions, according to the embassy, these forms are generic, and contain many questions irrelevant to the k1 visa petition.

I found this on another website

"Question 36 - "Has anyone filed

an immigrant visa application on your behalf?" - only answer yes if it

really is yes, - the I-129f is a non-immigrant visa, so unless you have

previously had another, immigrant, visa filed for you, the answer is no."

Frankly this whole immigrant, nonimmigrant confuses me...isn't everyone who comes here an immigrant? So, I guess the answer is no for the question. Let me know what they tell you at the embassy, but I'm pretty sure it's no now!

You know I printed out those example forms, I don't know why I blanked on #36 since it says no on the example!! All these forms are getting to me... lol. I put "with appropriate authorization" - although my example form has just no checked off, maybe it's a different example?

So just found this on that website I mentioned as well...

Please note that the DS-156 is used for ALL non-immigrant visa

classifications. So the "study" question is relevant to an application

for a B, F or M visa. It is actually irrelevant here. (what Yodrak said!)

On the "immigrant petition" end of things, the K-1 is a strange hybrid

-- it is a "non-immigrant" visa which looks forward to getting immigrant

status. It leads to a 90-day admission for the purpose of getting

married. So the visa is NOT directly for entering as an "immigrant."

So you really can't go wrong on that one!

well that cleared up the immigrant/non-immigrant thing. I think each embassy answers that question differently. Ugh, I really can't be bothered to call mine!!!!!!!!!!!!!!!!!!!! :wacko:
