Hi every one. This is a great site. I need help on what I should do now. I filed a I-129f last year, she went for the interview Sept. 2008 and did not receive the visa because they said "the claimed relationship is a sham entered into to evade immigration law." They never denied the visa's. So we got married Oct. 2008, I came back to the US, filed an I-130 in December, and finally got my approval July 10, 2009. Now here is the confusing part. After getting the approval, I received an Email about the I-129f saying" This case has been received from the State Department with a request we review it.

On July 16, 2009, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review"

I was told its very bad to withdraw the I-129f. I talked with Marc Ellis. What should I do about the I-129f? They never sent anything else to me. Thank you

The I129f was voided the moment you got married. Simply notify the agency that you are now married and cannot continue with the 129F and are currently pursuing an R visa.

AOS Timeline

4/14/10 - Packet received at Chicago Lockbox at 9:22 AM (Day 1)

4/24/10 - Received hardcopy NOAs (Day 10)

5/14/10 - Biometrics taken. (Day 31)

5/29/10 - Interview letter received 6/30 at 10:30 (Day 46)

6/30/10 - Interview: 10:30 (Day 77) APPROVED!!!

6/30/10 - EAD received in the mail

7/19/10 - GC in hand! (Day 96) .

just tell them you married and dont need to review any longer, apparently they dont have cross ref anywhere to keep themselves informed, we got a letter about our k1 after he was already here on cr1

I got the same letter, then just yesterday they sent me an email saying they denied the K1. So I am very confused have not gotten my letter yet. I am very worried

Hi every one. I want to thank you all for your responses. I will send a letter to them saying we got married. I never heard of Marc Ellis until reading about him on this website. First I Emailed him, then I spoke with him on the phone after reading his post http://www.ilw.com/articles/2006,0323-ellis.shtm I was worried about the part that said " Because the petitioner did not respond to the K-1 revocation notice, the beneficiary has a 212(a)(6)©(i) finding on her record. Even if the petition for her is approved, she is permanently barred from entering the US, unless she can obtain a waiver to that ground of inadmissibility. " Again thank you all for your help.

Sounds like you are on the right path. Clean up the K1 and go forward on the CR1.

Hi all. Thank you for all the responses. I have 2 other questions that I would like your help on.

1). When I did the I-130's for my wife and step-children, I used a lawyer. He charged me over $2000, and that was ONLY to do the I-130's. Now I have the approval letters, and it went to the NVC. I paid the fees to the NVC and talked with my lawyer. He told me if I wanted him to help with the AOS and the DS-230's, it would be another $2000+. If I do not want to use the lawyer now, and try doing the paper work myself....what do I have to do?....do you think it's a good idea to change from a lawyer to doing it myself at this stage of the game??

2). When all the paperwork is complete in the USA, I want to go back to Vietnam to be with my wife and wait until she has her interview. Please tell me your thoughts on this. Thank you.
