NaRocks suggested i ask this here as well, might hear of other Canadians who went through it etc...and so i am.

David and I finally got a reply from his congressman about our K1 delay. Turns our David (usc) is going through fbi background checks which is why we have not been approved yet. No one at uscis, our congressmen or the lawyer can tell us how long this has been going on let alone how much longer it will take.

Anyone have this happen to them or heard of it at this early stage of the K1 process? Our petition is at CSC.

The only thing David can come up with is that his work had a check done on him 2 years ago when he got his job at The Salvation Army.

We think they are doing a whole interpol check as well since the comopany is pretty much world wide...but i mean he is the USC for crying out loud..:(

Right now i've been banging my head against the walls..wondering if we're ever going to get a break:( Blurgh.

He had a truancy when he was a teenager..but that would be juvy record..would they pull those as well? i know here they are locked and you can't get access to them for the most part.

any thoughts or suggestions would be appreciated..ty :)

As far as I understand FBI name checks are done on all american petitioners as part of the process kind of like how we have to get police certs only more serious for them. From the looks of some other peoples timelines it can take a while for it to get done just for the fact that its simply slow and takes time for the person to go through the means to do it.

For Military people the background check takes little to no time cus they are military and have to deal with that stuff all the time specially with their security clearances they have to have for work. ( My fiance is military and our stuff has been approved pretty quickly )

Just hang tight and im sure you will get it soon!

Your lucky that you were able to get a congressional inquiry, most people have to wait at least 6 months for that. Mostly because until 6 months the USCIS will tell you that your within the normal processing times.

It's possible that his name is close to someone elses, David is a fairly common name. It's also possible that the USCIS made it up just for something to give the congress office.

I wouldn't get yourself too worried even if he is in extended background checks and if he's done nothing wrong than he will get out of the background checks and on to the next part. A small hurdle definatly not a brick wall.

Just to bump it up in the forum, Not sure on what they are checking for. I have a few skeltons ( I am the USC ) ( even though we did not do the K process ) , my husband was in name check so they said but only for 31 days after our interview. I am hoping something happens for you soon :)

Why is it that the only one who can stop the crying is the one who started it in the first place?
