K3 Done, tried to do CR1 before k3 but...

Timeline

My wife is now in the USA as a K3 visa holder. However, I tried to get the CR1 done the same time, hoping to switch the interview. Unfortunatly we could not, and we could not wait to be together, so I went back and brought her home with me.

Can I somehow have my I130 transfered to a AOS? Is there an easier step? Can I pursue the I130 still, while she is in the USA?

If she is here on a K-3 - then you would need to fill out the I-485 to AOS, as per the guides

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes you can pursue the CR-1. That's the way the K3 was set up originally. Cheaper and better to still go with the CR-1.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

yes, but she will need to go back to her home country to interview for the CR1. A friend is doing just that next week. She entered on a k3 but followed the CR1 thru NVC and is goin home for the cr1 interview next week. Thats saves you the AOS from the K# but you'll still have to lift conditions in 2 years(unless you've already been married over 2 years)

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Okay I just wanna make sure I have this straight since I am in the same situation. I wont to bring my husband here on K-3 but I was told like Bobby mentioned you then have to fill out the i-485 to AOS. Everyone has always given me that same answer. Is it true that you can still continue with the I 130 with NVC while your spouse is over here on a K-3.

If your I-30 was transferred to the NVC you can continue with the IR1/CR1 visa. Your I-130 NOA2 will tell you where the I-130 is. If it says the beneficiary is in the United States then the AOS is the way to go because the I-130 was sent to the NATIONAL RECORDS CENTER. It takes about 6 months to get the I-130 out of the NATIONAL RECORDS CENTER and another $340.

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony
