Regarding Form I-864: How do we provide proof that the intending immigrant’s current employment will continue from the same source? Does this proof come in the form of a letter from intending immigrant’s employer?

For the Affadavit, it is the petitioner or joint sponsor who will need to show proof of employment if they are going to use that as a basis of fiancial sponsorship. Hope this helps.

We did this with my spouse's pension income.

Can you clarify your situation, please? It's quite unusual.

If the immigrant will be working for the same employer, but in the US, a letter from the employer would be a darn good start.

I am currently working on H1-B visa. And my wife who is my sponsor, her income does not meet 125% poverty guidlines. So they are asking for prrof that the intending immigrant's (thats me) current employment will continue from the same source.

Oh, that's easier.

The old requirement used to be that you two must have been living in the same household for 6+ months to include your (immigrant's) income. That has quite possibly been reduced or eliminated under the new I-864 guidelines (new as of July06).

We provided the documentation from his pension fund showing the agreement, and that was sufficient to show his income. You can document your income the same way as anyone else---tax returns transcripts, W-2s (and/or 1099s) and an employer letter. Nothing really *is* forever (job), but we can hope, right?

The new guiedlines doesn't mention anyting about living in the same house for 6 months. I don't think that will be an issue. We've been married only for 2 and half months. Thanks for your help.

The new instructions are very inclusive, indeed! Way more in line with reality, too!

"Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her incomecan be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident."

As long as you don't immediately quit your job...
