Land Ownership and Foreign Nationals

Land Ownership and Foreign Nationals - Generally speaking Thai law prohibits foreign nationals from owning land in Thailand. The definition of a "Foreigner" is a person not of Thai Citizenship or juristic entities such as companies which are owned or have a controlling allocation of a foreign national.

Thai Nationals married to a foreigner were also prohibited from owning land in Thailand as it was presumed that a spouse may be holding the land on behalf of the foreigner. Recently this stance has been amended and the current policy is that the Thai spouse may own land however the foreign spouse must sign a waiver to state that they have no interests or claims to the land and that the land was paid for by the Thai spouse.

Under certain circumstances the law does make allowances, such as section 86 of the Thai land law. This law decrees that a foreigner may own land if permitted to do so under a treaty between consenting countries. The predicament with this method is that there are currently no such treaties in existence.

Foreigners cannot use a Thai spouse as a nominee to buy property in Thailand, however.

“If the Thai spouse has enough money to buy the house that is fine, but if the Thai has no money and uses money given to him or her by a foreigner to acquire property, that is against the law. If we check and find out later that a Thai person has been using money from a foreigner to buy land anywhere in Thailand, we will revoke title deeds,” he said.

Is this very recent or is it symptomatic of administrative rules and laws that change with great frequency?

Is there a tradition in Thailand of such laws being challenged by the courts?

We will have to watch this in the future. She has land so I won't be paying for that but

I would be paying for a house if we decide to build one. She may also have enough

funds to buy one on her own, but we'll come to that bridge when we cross it.

This is from May of 2009. Like I was saying, they seem to change the rules on a regular basis. I personally know of quite a few farangs that gave their Thai wife money to buy that land, and then had to sign some document stating that if there was a divorce, the farang has no claim to the land.

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
