maybe someone from Thailand can answer this... My wife will be getting land from her mom. Can she give the land to her kids, if they are American citizen's ?

I don't know about Thai Land, but for Viet Nam is NO, NO, and NO.

I don't know about Thai Land, but for Viet Nam is NO, NO, and NO.

If your son has Vietnamese passport and Vietnamese citizenship, it will be "YES". That's the new law. Pls check with your VN relatives.

mmm I guess that depends when the become 18. I really can not see them living in the county side in Thailand, There is not work there and if they have their pick, I think they would pick USA to live.

You never know? It's always better to has a house back home. Maybe for vacation or getaway.

which I have no idea of the answer is:

If your wife becomes a US citizen, who owns her Thai property because she has become a farang?

My fiancée also owns real property in Thailand but we haven't discussed the possibility of her changing citizenship.

I think it might not be a good thing because we have been talking about building a house on her land.

Do you have a source for this ? They are talking now about doing all the deed changes soon, just fight over the detail. If this is true then Nan will just sale the land. I know our kids would never use it, But I would love to build a summer / retirement home there.

The Dual citizenship question was about Chase our son and what happens when he turn 18. I think next month when we are in Bkk we will go get him a Thai passport. right now he has only an American passport. We do have plans for him to spend the summer in Thailand when he get older and to go to school there also.

I too would like to see where that has been enacted. I just copied it to my SO and she

says she's not sure if it's true or not.

or US citizenship, or by neither, just by marriage to a farang?

Do you have the link to the actual Thai Law? I thought it was a scare tactic for the developers in Phuket, that were marrying girls and buying land through them? Get married and next thing you know these girls who had no money buy millions of Baht worth of land.

I have a friend that is Thai, and has citizenship in both countries, he uses his US passport to enter the US, and his Thai when he enters Thailand, he has never had a problem, or been questioned.

Land Ownership and Foreign Nationals

Land Ownership and Foreign Nationals - Generally speaking Thai law prohibits foreign nationals from owning land in Thailand. The definition of a "Foreigner" is a person not of Thai Citizenship or juristic entities such as companies which are owned or have a controlling allocation of a foreign national.

Thai Nationals married to a foreigner were also prohibited from owning land in Thailand as it was presumed that a spouse may be holding the land on behalf of the foreigner. Recently this stance has been amended and the current policy is that the Thai spouse may own land however the foreign spouse must sign a waiver to state that they have no interests or claims to the land and that the land was paid for by the Thai spouse.

Under certain circumstances the law does make allowances, such as section 86 of the Thai land law. This law decrees that a foreigner may own land if permitted to do so under a treaty between consenting countries. The predicament with this method is that there are currently no such treaties in existence.

Foreigners cannot use a Thai spouse as a nominee to buy property in Thailand, however.
