K1 vs K3 !! confusing.... please HELP, thanks!!

:wacko: Dear everyone,

my American fiance and I are deciding to apply a visa for me to get back to America to start our beautiful life together. We don't really wanna hire an attorny, because we are able to handle the process on our own.

But one thing is really really confusing, which is whether to apply for K1 or K3, whether we should get married in China or in America.

which visa will be faster to obtain/approve, K1 or K3?

Please offer me some your experience and suggestion.

a daily question....

K-1 by design is faster because you could theoretically begin the petition TODAY.... for a spousal visa you must wait until a marriage event has occured before petitioning (unless of course you could get married TODAY).

8/1/12: ROC window opens
9/4/12: ROC packet sent
9/8/12: ROC packet delivered to VSC
9/12/12: Check cashed
9/14/12: NOA letter received (NOA dated 9/10/12)
9/20/12: Biometrics letter received (Bio appointment 10/15/12)
10/12/12: Early biometrics walk-in

4/27/13: RFE received

6/17/13: RFE response sent

7/1/13: ROC petition approved

7/5/13: GC received in the mail.

I was told K-1 was the fastest route. And that's what I did. However, I am not sure if that's true through a lot of reading on the forums. Especailly when you are in China. GuangZhou has a electronic option for CR-1. You might want to do some research before deciding. But then again, with the time you spend researching, it might be the same in the end. Good luck!

Consider K-1 or CR-1. K3 is of limited value, the CR-1 is better in most cases.

K1 gets you here faster but you cannot leave or work until you adjust status (4-8 months from arrival typically, could be faster) CR-1 takes longer but when you arrive you get a green card and can work and travel right away. Take your choice. Overall time for true "completion" is about the same but you get to be here for the AOS phase (with restrictions on work and travel) with the K-1
