Hi all.

i have a question here,

i was browsing some threads in this section and i found something and i would like to know about it ..

ok, when i came to united states i came throuth marriage i got Approved on my I-129F so the embassy gave me 2 years Visa, and then i waiting for my I-130 to be approved but never happend .. but i was told that still i can apply for my Green Card. and Yes i did. i applied for my Green card and i went throuth interview and i passed it and i got my 10 Years green card with no problem. now the time is going fast and i am almost to apply for my Citizenship. but the question is .. i saw some one post here that when she arrived to usa she got her 10 years green card, it means she dint get her 2 yeas green card. (the temporary one) and after 3 years she applied for her citizen ship and she was asked for her I-751 removing condition. this what i dont understand .. is this going to happen to me to because i dint get the temporary one. or it doesnt matter. !!!! by the way i never got approved on my I-130 i dont know how but seems after i passed my Interview for my green card maybe it approved automaticly.

I suspect your case is different from the other person you are referring to. She was mistakenly issued a 10 Green Card instead of 2 year GC, because her marriage was less than two years old as at the date of her initial approval.

I think you are good to go if no error was made when you got your 10 year green card (that you marriage was more than two years old as at the day you you were issued your GC.

INS started that conditional green card in 1988 due to a high number of fraudulent marriages to bring people here before becoming the USCIS. New immigration laws in 1986 started all this with a lottery of 50,000 maximum so marriage was the only way to come here. Claimed over two million applicants where about 80% of the marriages were fraudulent. But also severely made the application far more strict, since then, the average applications for the I-751 has dropped to around 140,000 per year. But still have to go through that conditional card thing if married for less than two years. But takes almost that long in addition to get your permanent ten year card that prior to 1986 was a permanent lifetime card.

Those that are completey honest and have met their love ones from a foreign country have to pay the price, but technically, can still fake a marriage for immigration purposes, but may take up to four years. And the USC spouse must be prepared to sign over half his assets to his fake wife plus risk five years in prison. If I as a USC spouse wanted to make some money by bring a person here, she would have to be a multi-milionaire, but if she was, wouldn't need to get married to come here. The USA welcomes anyone with lots of money.

Consequences of a strict immigration law has led to anywhere from 12-20 million illegals here that never was enforced, until recently where some of the states are taking action, while immigration is technically a federal matter, they aren't doing anything to correct the problem. But for those with honest marriages, sure making life miserable for us. Even with a legal green card, states, not knowing the immigration process can make life miserable for a LPR.

Unless you married an orphan, your spouse will have to leave family behind, and with a green card, trying to maintain a foreign passport can be miserable. US citizenship is an out, with marriage, one spouse has to be a US citizen, marriage, and the immigrant spouse all for at least three years, can apply 90 days before the 3rd anniversary of the lawful permanent residency requirement, but the other two factors has to be for three years. Plus you have to show residency in this country for at least, I believe 30 months and tons of proof that you are indeed married, all financial stuff mainly. Exceptions are available if you work for the government, but it's all in the M-476 manual the USCIS has complied in a mere 68 pages. But you still can have questions after reading it. This board may be helpful for that.

If you had been married for more than 2 years when you received your green card you would receive a 10 year card. If you had been married less than 2 years when you received your green card then you should have received a 2 year conditional card and need to apply to remove conditions before you can proceed to citizenship.

The reason you got 10 year Green Card is because you have been married for more then 2 years. Usually the Conditional Card is issued only if the couple has been married for less than 2 years (it's a kind of test of time). So you don't have to worry about anything and just apply for naturalization when the time comes. And good luck!

Yeah, if all that stress and frustration the USCIS caused by their extensive delays doesn't break up your marriage. Would be a much different story since they say to apply 90 days before your 2nd GC anniversay and issue that new card within that time frame. The the I-751 gives all kinds of loopholes if you didn't stay married, required evidence was an updated AOS, mainly tax returns, feel the whole procedure is BS. We got to the point of looking to countries that would accept both of us, but our senator helped us, with a strong motivation to apply for USC at the earliest possible date. The only means available to get the USCIS out of your life.

Hello, i want to ask about my I-130. Years ago we filied I-130 but it never got approved since maybe 2004, and still, but the thing is when I arrived to united states, i looked at my I-129F Approvel Notice, it was there on the back it says that i can apply for my Green Card. but we never did and the reason was is when we went to the Immigration office we were told that i cant apply for my Gc until i get my I-130 Approved. so i have 2 years visa expired and i was so worried but i dint listen to the Immigartion office and i applied for my Green card and YaY, i got my interview letter and i passed my Test and i got 10 years green card, with no problem. now i am going to apply for my citizenship and i am worried they will ask me for my I-130 !!!!!! do u think they will ! i keep Cheking my case online but it nothing, still I-130 Pending. should i call the Immigration or make Infopass? to ask them !!!! i was told that if i get my Green card then the I-130 approved Automaticly. but i am not sure!!!

so what do u think guys!
