Hello everybody,

Me and my wife just got married, I am trying to figure out some details. I did quite a bit of research, but everything is very confusing and was wondering if you people with a little experience can assist me. First off, I am a US citizen (born in the US) and my wife is from China. She came to the US for school. That being said, she does not have permanent resident status yet.

My question is on the I-130 instructions, it states under the section "NOTICE TO PERSONS FILING FOR SPOUSES, IF MARRIED LESS THAN TWO YEARS" that Both you and your conditional resident spouse are required to file a I-751, Joint Petition to Remove Conditional Basis of Alien's Permanent Resident Status, during the 90-day period immediately before the second anniversary of the date your alien spouse was granted conditional permanent resident status.

However, like I said my wife does not have permanent status in the US. BUT we are married for less than two years. Can anyone point me in the right direction if I need the I-751 form or not? So far I know I need the I-130, I-485m and I-864. Any help would be really appreciated. Thanks for reading.

I think you will find you first need to file AOS (see Adjustment of Status forum and guides, link below) to receive conditional status. Then just under two years later you need to file the I-751 to remove those conditions. That is what this forum is for.

Yep!

As already mentioned, the I-751 is something you get to look forward to 90 days before the expiration of your conditional (2-year) LPR/Green Card.
