Your K3 is "processed" at your U.S. Service Center (for the I-130 part) as well as the Missouri Service Center (for the I-129f part).

All interviews for Canadian spouses are done in Montreal or Vancouver. No Toronto interviews. (Not sure if you can do Direct Consular Filing in Toronto, though, or for which visa.)

Only Vancouver and Montreal issue the kinds of visas we deal with regularly on VJ.

Hybrid "non immigrant" visas (the K-1 and K-3) can interview at the one serving the beneficiary's Canadian residence.

Immigrant Visas (CR/IR for our cases) can ONLY be issued in Montreal.

Direct Consular Filing is only available to USCs who are normally resident in Canada. If they are, the I-130 can befiled at any Consulate in Canada except QC and there would be no I-129f or K-3 visa.

JerseyGirl, the I-130 is processed at the US Service Center, the I-129f (for a spouse) is processed at MSC and the K-3 visa application is processed in the Consulate.

Thanks for the quick replies! Is there a significant disadvantage to specifying TORONTO as the preferred city on I-130 and I-129F? Who decides which city anyway?

The disadvantage is only in wasting people's time and your ink. The I-129f/K-3 interview can ONLY take place in Vancouver or Montreal, the I-130/IV interview can ONLY take place in Montreal.

You can look up the Consular websites for those posts to see which one of them serves residents of Toronto. This designation has already been made by the US gov't.

OKay.. well.. i am under the same circumstances. I contacted Toronto Consulate.. they said that they do not deal in K-3 or K-1 visas. K-3 and K-1 is done by Vancover and Montreal Embassies. Vancover having very small area of jurisdiction. If you are in BC then Vancover is the station to go for.. if not then Montreal. All Immigration CR-1/IR-1 is taken care at Montreal Embassy.

According to the Vancouver consulate:

The Consulate in Vancouver processes fiancé(e) cases for citizens of Canada, or aliens who are permanent residents. Individuals in Canada on student and/or employment authorization will be considered on a case-by-case basis. Such individuals must be authorized to remain in Canada for a continuous minimum period of six months (from the time the approved petition is received at the Consulate). Applicants must also be residing in British Columbia, Alberta, Saskatchewan, Manitoba, the Yukon or the Northwest Territories. All other applicants in Canada are processed at the U.S. Consulate in Montreal.

sobby, are you a Toronto-Connecticut couple? If so, Montreal isn't far from the U.S. by car. It's even a hot vacation spot (with a casino) for those in the Tri-State area. For the Torontonian, Montreal's a 5-hour drive or a pleasant train trip from Union Station. Better bone up on your 10 French phrases if you file for K3!

Exactly. Vancouver does not process IR1 or CR1 visas. They only process K-3 and K-1 visas just due to the fact that Montreal Embassy is too busy and it has a small area of jurisdiction as compared to Montreal. I mean a very large amount of population lives in the area other than those that come under Vancouver jurisdiction. Due to this, Vancouver is able to process applications much quicker than Montreal Consulate. Also due to the workload in Montreal with IR-1 / CR-1 plus K-3/K-1 visas.

Vancouver interviews K3 and K1 for Canadians who live in Manitoba, Saskatchewan, Alberta and BC. Montreal interviews K3 and K1 for Canadians who live in Ontario, Quebec, PEI, New Brunswick, Nova Scotia and Newfoundland. I'm guessing the territories are geographically subdivided as the provinces are, and would therefore go to Vancouver. Perhaps residents of Nunavut would go to Montreal tho...hard to say.

Montreal processes all CR1/IR1 spousal visa applications.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
