We are so HAPPY!!!!! We did it, yesterday we went and got married. My "Husband" Chad is an Australian citizen and is here on a visa waiver. We're not really sure what is the next step. We want to file for a change of status and start the process immediately. His visa waiver is until September 7th. Please is anyone could direct us in the right direction. Some family and friends have suggested that we retain an attorney. Should we try and do that? Is that the best thing to do?

Congrats!!!!!

I think, someone else please correct me if I´m wrong, to be able to AOS, the non citizen has to be able to prove that he came to the US without the intent to get married.

If that can´t be proven you guys will have to do either the K3 or CR-1 and he´ll have to go home to Australia during the process.

No we didn't plan this at all. He actually has a doctors appointment in Australia next with a specialist that took him several months to even get and his medications run out shortly. Obviously now he can't make it but he had a lot of things coming up there, that's the reason why his trip was only 7 weeks instead the full 90 day visa waiver period. It's just as his departure date neared we both got so sad and couldn't bare it. I went to the post office last week and applied and paid for passports for both me and my daughter so that we could fly to Australia in September to see Chad and meet all of his family and friends. Now when the passport comes in I have to have it changed since we're married and I took his last name.

You can try to file for AOS. It's not allowed for people under visa waiver to file for AOS (you can read it on form I-94), except an immediate relative to a USC. The problem is that your husband can't travel outside the US during the whole process. Another problem is that your husband can't get a working permit during AOS.

However, you have to prove that you didn't plan the wedding.

09/17/2009 - received and paid AOS fee bill (paid online)

09/18/2009 - NVC accepted DS 3032

09/22/2009 - received and paid IV fee bill (paid online)

If Chad needs to leave the US by September, you may not have time to file AOS. You may want to expand on your plans to get better information.

hi, i was from melb too, what part of melb, i was in the southeast near morrabbin, and now im living in Louisiana USA congrats on your wedding, but can i ask is it hard being away from your hubby? we were going to get married then do the k3 but i diddnt want to spend my first year of married life away from him, im so glad i waited!! good luck
