k1 visa expires in 5 days but we still waiting for our marriage certificate

pleeaaaaase someone tells me what to do

i entered to the usa in may 7th , we got married may 8th, religiously, then legally in june 30 and in july 10th we send our marriage license , butt they

say we cant get our marriage certificate in less than 4 weeks, so the problem is that my k1 visa expires in august :innocent: 5th.

i wanna know if there is any problem in sending aos after visa expiration date yet we got married within the 90 days :innocent:

You are required to marry your SO within 90 days of arriving in the U.S. in order to remain legal. You have done that. I don't think it will be a problem.

By the way: 4 weeks to get a marriage cert? Ouch! That sucks. Where on earth do you live?

Your K-1 Visa doesn't expire in August - your I-94 does.

You will be just fine submitting your AOS/EAD etc after the I-94 expires - before is always better, but after is OK too (sooner the better obviously). All you can do is wait for your marriage certificate and have everything else ready. Don't worry... :thumbs:

So others can learn from this - in many states what the OP has described is not uncommon - for whatever reason, it takes quite a while to get the marriage license recorded (sometimes days, while a couple of weeks is common).

In many states - it would be better to (once you're married) hand deliver the marriage license to your local County Clerk's Office (or which ever governing body handles marriages) and have them record it right then and there - Skipping the steps a marriage-officiant would do. In our case (in Texas) what would have taken a couple of weeks, we accomplished in a day.

yeah, they said they will send it within 4 to 6 weeks, but as austin says, this can differ from state to state. and thank u for ur answering me. thank u so much.

Your K-1 Visa doesn't expire in August - your I-94 does.
