Hi all...

I am new to this forum and not exactly sure where to post this question but I think this looks kinda more appropriate.

We live in the USA and are from Pakistan.

My husband is a US citizen and earlier this year he file the I 130 for his mother to bring her here.

We still haven't heard anything more from them after the cheque we sent in was cashed and we got that letter of receipt thing.That's understandable that the whole process might take upto 2 years give or take.

now the problem....My mother in law just got a 12 month visit visa for Australia and she might be leaving pretty soon.My husband wants her to go to the US embassy there in Pakistan and get a visit visa for USA so that she can fly from Australia directly to USA ....

My question is....is it possible to get a visit visa when you have already filed the I-130...???

Because my understanding is that you can only apply for one mode of entry into the USA at a time...and not multiple applications and see where you get lucky.I also heard that if they know that you have already filed the I-130 they deny the multiple visit visa right there and then.Please tell me if this is true or not...??

With the visit visa they grant you either a 3 or 6 months stay in the USA and then you have to go back.My husband thinks that once his mom will come here he can send in a status adjustment application thingy and then she can stay here indefinitely till she gets the green card.

Any experiences or similar situations....??

Yes she could apply for a Tourist visa to visit the USA. The fact that there is a I-130 in progress would not stop her getting a tourist visa, She whould have to show very strong ties to her home country before a visa would be approved.

If she was to get a tourist visa to the USA and come to visit as a tourist with the intent of then filling for adjustment of status, she would be commiting Visa Fraud. You can not use a tourist visa as a quick way of getting entry to the US and then staying. It is illegal. The reason it is so hard for some people to get a tourist visa is because of people trying to do exactly what your husband is thinking of doing.
