Timeline

I hope someone here can help me. I brought my wife and youngest stepdaughter he in a K-3 visa. My oldest stepdaughter who was 18 when my wife and I got married ( she is 20 now ) decided that she wanted to come here to. She came on a K-4 visa so my qustion is how long can she stay in the country and how long will it take to get here to be able to stay her permanently?. If anyone has any answers for me they can respond here or reply directly to my email. gosselin546@aol.com Thank you in advance for any help you can give us.

If your daughter came on a k4 visa she can stay as long as her visa is valid.After the visa validity she can adjust for her status to get her permanent residency .correct me if am wrong ppl.

If your daughter came on a k4 visa she can stay as long as her visa is valid.After the visa validity she can adjust for her status to get her permanent residency .correct me if am wrong ppl.

You cannot adjust status from K4 over the age of 18. She can stay for the validity of her I-94.

Since she was 18 at the time of the marriage, the USC cannot petition her as a stepchild. The mother will have to petition her as F2 category.

That's right for a K4 (Not so for the K2.) but she doesn't get to stay in the US past her visa expiration. Her best bet for staying is a student visa followed by marriage to a US Citizen or the eventual success of an F2 petition. She'll wait several years for an F2 visa to become available for her.

I want to thank everyone for their help. I think the school route will be the easiest. I will try that first and see what happens.

A student visa is a non-immigration visa where the applicant must overcome the presumption that he/she will not become an illegal alien. Under the circumstances that you have described; mom and little sister having immigrated to the US and your attempt to get her here as quickly as possible, it may be difficult for you to overcome the presumption.

Good luck with the student visa. If she doesn't get one and her mother files for her, it will be about 9 years before she will be eligible for an immigration visa.

You cannot adjust status from K4 over the age of 18. She can stay for the validity of her I-94.

Thank you for the correction. Yes you are right i missed that "18" part.
