i need help and advice..... i will get right to the point... i am married to a colombia women how traveled to the united states with her K-1 Visa during her stay we married we both had some problems and she went back to colombia to deal with some personal problems we both have been talking and we both have worked out our problems. How do i get her back into this country... she never over stayed her visa. we filed all her paperwork for her greencard and travel doc's before they arrived she went back home. she also had an apointment date for her green card interview she missed the date and never went. so the bottom line she is in colombia and i am here we are married.. ??????

As I understand it, if you missed the interview, the petition is considered "Abandoned", and you will have to re-file, but its a different ball game now because she is in another country. I believe you have to file for a different type of visa, and it has to be done before she can come back to the US.

This is just my understanding, I am sure someone will post that can give you thourough advice to get you through. This site has very helpful members who always come thru.

04/24/2009 Papers delivered to Lees Summit (MSC) :o)

05/07/2009 Received email from CRIS that EAD card has been ordered & should arrive within 30 days

05/08/2009 Received email from CRIS that EAD Approval Notice was sent

05/09/2009 Received EAD card in mail YAAAAAY

05/12/2009 Applied for Social Security Card

05/15/2009 NOA received with I-485 interview date 07/20/2009

07/20/2009 AOS Interview in Orlando FL

07/21/2009 Email received " Card Production Ordered " YAAAAY 139 days!

07/24/2009 Welcome letter received! & Approval of I-130 also received! Yaaay

08/04/2009 Green Card received! Hoooraaaaay!!

looks like you have to refile. i'd get in touch with USCIS as well. sorry to hear about your problems! :(

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

They will allow her to come back, but you will need to file for a spousal visa first (CR-1). The good thing is that with that visa, she'll be able to work right away if she so chooses.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
