i had my citizen test yesterday and i passed the test but they didn't approve me because they didn't have my A file. and i never got my I751 aproved or told me anything about it since i filed it, i file for my 751 like almost 2 years now and still didn't hear anything back about that.

did anyone have any idea on what's going with my case, i just can't get an answer from anywhere. please help

So your GC is expired?. How did you get and interview apptmt?. I don't get it.

11/1999 - We met in Ecuador

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

yes i do have an expired GC now because i never got the 10 years one until now, i have been told that i can file the N400 even though my I751 not approved yet, for some reason since i filed the I751 until now haven't hear anything about I751 yet but the funny things i got a quick answer on my N400 and i even got interviewed and passed the test but never approved because they didn't have my A file where all my history with them is. so i'm lost in this delema now. anything that i need to clearify more?

It sounds like they are just waiting for your file - all of the different applications that have been submitted and the decisions made about your applications - to arrive. It seems like it is in another location and not yet connected to your citizenship application. I strongly suspect that since your I-751 hasn't been approved yet that your file is where your I-751 application is awaiting decision. The N400 application is supposed to 'force' a decision on the I-751 so they are probably tracking down that file, they will then review it, make a decision on your I-751 (which is long past due!) and then send you notification for your oath ceremony. Sounds like you really did need the N400 to get them to move forward on the I-751, so it is a good thing you filed.

If it goes beyond 30 days contact them again. If that is not successful, then get your senator involved. You've waited more than sufficient time for them to make a decision.

In the meantime, you can also make an Infopass appointment at your local USCIS and ask them to put the I-551 stamp in your passport. That will be proof of your legal status in the US now that your green card is expired. You can do that at http://www.uscis.gov then select "schedule an appointment' from the right hand column and follow the instructions.

thanks kathryn41 you made me feel better now. because it's start getting under my skin because i have done everything right but for some reason i couldn't fegure out what was going on with my I751 that took right now over 2 years. ah i well i guess i will just sit and wait and see what will happen. thank you guys for the feedback.

so how was your interview ? give us some details..

the interview was really smooth beside one incident. i had an appointement for 8:30 so i was waiting and waiting 9:10 still no one called my name so i was wondering because people with 9 o'clock apointment have been called in and not me, so i asked one officer when she opened the door but man that woman was mean. i told her please i have 8:30 appointment and it's 9:15 now and other with 9 appointment are already been called in, and she was like WHEN IT'S YOUR TURN WE WILL CALL YOUR NAME. so i swallowed that. and finally the officer that was suppose to interview me was kind of behind and first thing she said that she was sorry about the wait. i was relieved after that because i was like at least i didn't get a pissy one. so we went to her office she made me swear and then sat down and she told me that she will asked me 10 question but he i answered 6 correctly i will pass. so she asked me what is the name of our national antem? what is the rule of law? how many senators?what is the 4 amendment that were added?something like that and the name the ocean in the west cost? and what month do we vote the president? after that she asked me to read one sentence and she took that back but she asked me to write the same sentence that i read and that was it with the test, it didn't take like 10 minutes, after that we went though my application everything one fine and gave her my tax return from the 2008 since i didn't have them when i filed. and that was it and she told me that i passed and she will not approve me as she doesn't have my A file. but i should received a letter if she needs more info or i will receive and letter with my oath ceremony and that will take about 3 to 4 months. so i left their office and logged in here and asked if anyone experience the samething. My wife's A file was "misplaced" twice, for the I-751 and after she successfully passed her interview, both times, our senator made the inquiry for us and both times, the USCIS found our A file, a couple of days at California, and in just two hours at St. Paul. Feel it has something to do with the lack of organization within the USCIS, they are shipping these files all over the country. It's not that you or I did anything wrong, we are helpless, make an infopass appointment or call the USCIS toll free number, you just get a runaround. Takes a senator, ours happens to be on the budget committee for the USCIS to get any action done. They did listen to him, won't listen to us kind of thing.
