I had him too. He was able to look right through my ex wife's lies and told me so. He has also helped quite a few people on here secure their visa's. Ellis is well worth a $100 consult fee, if nothing else.

1.- Personally I do beleive that hiring attorney is a waste of money & time (experienced) unless you could find a briliant & whole-hearted attorney who could vote their time to work on your case.

2- If refiling is "the best", please tell if the previous petition needs to be canceled, and how to file for a cancelation of petition to the USCIS ?

There are situations that most people are not versed enough in that could do them more harm than good by proceeding w/o and atty.

My fiancé did call to senator and congressman for our case. Yet that didn't help at all.

You might be right at what you just said about. But I am sure of what I said about. Just let VJ'ers know more of other cases such as ours.

For your reminding me of timeline, FYR, our K-1 petition was filed to USCIS since Mar-2007.

Same here. I also hired ME ($600: $100 for conversation only; $500 is for the rebutal letter) after my fiancee got the denial sheet. Unfortunately one day after ME wrote and submitted a letter for me, the Consulate sent my case back to USCIS! Although my K1 is currently being "reviewed" by USCIS, I'm going back this Sept and get married. We will try to get a marriage cert in Vietnam and refile CR1 when back in the U.S.. I cannot put my life on hold because of a Visa and I'll show them how genuine our relationship is. I'm 36 and want to have a kid real bad. I know it's tough to convince the Consulate in VN but our true love shall prevail.

Due to the separation of powers clause in the Constitution, usually the only thing a Congressperson can do is monitor your case and make inquiries for you. I have gotten help from my Rep and one of my Senators, but only in asking questions on my behalf. They cannot force a decision to be made in your favor. I tried to get my Rep to stop our petition from being sent back to the USCIS, but they could do nothing.

Hiring an attorney is a personal decision. If you have no red flags and are confident in filing and dealing with the paperwork you don't need an attorney. VJ is all you need.

I filed my K3 (2008) rebuttal at the same time I filed my CR1/IR1(2006) rebuttal , even though the USCIS had not received the K3 petition back.

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

who is Mc Ellis ? where he live ?

Marc Ellis is an immigration attorney who lives much of the time in HCM. He isn't there right now, though. He returned to the US a week or so ago. I'm not sure when he's going back, but you can send him an email.

I doubt there is any attorney who knows the US consulate in HCM better. No attorney can guarantee you'll get approved, but if I was having trouble with the HCM consulate I wouldn't trust anyone other than Marc to help.

I know there are many people who feel that having a child together is going to give them the best chances of getting approved in HCM, but I have serious doubts this is true. I've read a number of cases of people who've had kids together and still had their cases sent back to USCIS. Unfortunately, this process can take several months or several years, and it's even possible (though unlikely) that you might never succeed. Why would you want to risk being separated from your kids, or having your kids separated from their other parent for this long? If you want to have kids because you think it's the right time in your life to start a family, then go for it, but don't do it because you think it will help the immigration process. If it really did help, don't you think the fraudsters would also be willing to do this? Having a child doesn't prove a sincere relationship any more than any of the other evidence you present to them. It only proves you and your partner have had sex, which is probably true of more than 95% of the people who apply, both sincere relationships and frauds.
