Fiance' from Belarus. Whats taking USCIS so f#$king long?

Timeline

Its been 6.5 months and still no NOA2! Our case seems like it should have been easy. I make enough $, no criminal record, never married etc....

My fiance was married before but has been divorced since 1995 and I sent them the divorce certificate with russian translation. She has no criminal record ,we are both of similar age etc... but this damn thing seems to be dragging on forever.

Is there a problem with Belarus in the eyes of USCIS? :angry:

Have you tried calling the SC? How about your congressman?

I know a couple similar to you who haven't received their NOA2 and they filed in December, 2008.

Keep up the relationship; it will come.

yeah, ive called the service center a few times but seems to get me nowhere. they just read a canned response and tell me to keep waiting.

called my congressmans office yesterday and they had me fill out some form then they said they would contact CSC and see whats going on.

it has definately put a strain on our relationship but with many phone calls and sms messages all is good.

According to your timeline, you received an RFE June 25th but do not show when you replied to it - presumably you did (reply) and are awaiting a response. The (kind of) good news is - had you not received the RFE, your petition would very likely have been approved on/about that date (date of the RFE). It is still a long time - but assuming your response was what they needed, you should be hearing something good very soon. :thumbs:

It is not Belarus... your petition would have been approved on June 25 if it had not been for the RFE

It is not Belarus... your petition would have been approved on June 25 if it had not been for the RFE

I was "touched" on July 17th and judging from what others have said for similar rfe's I was hoping for something within a few days but alas nothing....

If your timeline indicates when you responded to the RFE, the touch is the CSC placing your additional information into the file. You need to watch for additional RFE's before getting too excited. This has happened to lots of people and is why we always recommend a quick response to any RFE's.

I think you can expect a change pretty soon. Hang in there a little longer and tell your fiancee that you are getting pretty close now. :thumbs:

I sent the rfe next day air back to them but seems they only "touched it" on the 17th.

I would hope that if there was more than one rfe they would have sent them to me all at the same time?

I have only one suggestion which will prove very valuable to you.

Your timeline indicates the RFE was sent within the 6 month time frame, according to the USCIS site, before you should consider asking questions. As many have indicated you will most likely receive your NOA1 soon.

There is no rhyme or reason as to why some applications are processed faster than others. This first period of waiting for the NOA1, and longest wait, seems to be the most stressful. Relax and lengthen your fuse a little.

Timeline:

17 Nov 2008 - Sent I-129F to CSC

19 Nov 2008 - NOA1

03 Apr 2009 - NOA2 approval (email)

09 Apr 2009 - NVC received

13 Apr 2009 - Sent to Embassy

23 Jun 2009 - Interview date USEM - Posted USEM website 30 Apr 2009

No problems with Belarus...

It was 20 days from our NOA1 to NOA2 and the total time for us was 4 months and 4 days from NOA1 to visa in hand. Hang in there! Everything goes quickly once you get your NOA2.

No problems with Belarus...

Yeah, we were surprised it all went so fast too. We went through VSC which is usually the slow one. We almost hired an attorney but we decided to do it ourselves. I think a lot of it was luck... but also my wife is extremely detailed when it comes to documents as that was part of her job dealing with customs there... So between my wife and all the resources in VJ (cover letters, sample forms, common rfes, interview questions, guides) nearly everything went smoothly. Our only problem came at the interview when they asked for her university diploma. I think it was the only thing she didn't bring but they gave her the visa anyway.

thanks! good news is that yesterday i got an email saying "application has been approved!" so we are finally in the home stretch!
