Hi. I have a complicated case with my G-325A/birth certificate.

When I was born, my mom was still oficially married to her first husband(not my dad), because he wouldn't let her divorce. Mom was living with my dad, but they were never oficially married. By Russian laws at the time, my mom's first husband was registered as my father in the birth certificate. Then, it was destroyed in the fire, and she had to replace the certificate. Shortly after, her first husband died and my mother got her maiden name back. She went to replace my birth certificate, but my dad and her split up before that, and she couldn't get ahold of him to go and record my birth again. So, she decided to register me as though I didn't have a father. By the Russian laws at the time, if a child didn't have a father, they put his last name as the mothers last name,so that's what she did. Then, dad wanted to get custody of me, and he went to the court to prove tht he was my father. He got a document stating that he was my dad, but they never changed my birth certificate. I lived with my dad since I was 6, and visited my mom occasionally.

Now my parents can't change my birth certificate without me since I'm over 18 now, but I can't go back to Russia before I get a green card.

So, I have a dilemma: should I put the real dad's name on G-325A, or the hame that is in the birth certificate? I don't want to be a liar, but I don't now how to prove my case. If they ask me why does the name on G-325A does not match the birth certificate, I don't know what to do?

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

i had the same problem: my mother had moved back in with her first husband by the time i was born (my own father not wanting to have anything to do with her once she fell pregnant) and he demanded she put his name on the birth certificate. he was a horrible man whom she left a few years later, and i've had a step-father since i was 5... so it was a difficult question to fill out; i wanted to put my stepdad's name, since i consider him my father, but i had to put what was on my birth certificate. but if the BC is blank regarding your father's name, it may be okay just to write his name on the G-325A, and then make a note on your cover letter/table of contents explaining that this is your father's name, even though your BC is fatherless.

01-01-2009 officially engaged

04-06-2009 married

04-25-2009 filed AOS

05-22-2009 biometrics appointment

06-05-2009 EAD received

06-17-2009 NOA2 received

07-30-2009 interview- recommended for approval! GC expected in 1-2 months

10-21-2009 received NOA for the I-130: "your petition is approved but... the applicant for whom you are petitioning is not eligible to file for an adjustment of status at this time". still no GC :(

11-18-2009 welcome letter received!

12-01-2009 green card received!

september 2011 filed for removal of conditions

october 2011 biometrics appointment

december 2011 RFE received

january 2011 sent in RFE packet

february 2011 conditions lifted, 10 year green card received

I am not sure what is the RIGHT way, but I would use the name of the father that you have in your most current birth certificate. You also will need to submit a copy and translation of your birth certificate. Stick to the same name in immigration forms. I dont think they care about "who the true father is" as long as you have copies of valid birth certificate and there is no discrepancy with the father's name

Plus, when I applied for the visa to the US, I had to write names of my parents and my brother. probably, you had to do it too. What name did you put then? Stay consistent.

If you do have a blank in your birth certificate, write "none" in G-325 A. And if you want, submit an explanation letter or if asked at the interview, explain that your mother was not married to your dad at the time of the BC was issued. That is why it is blank.
