K3 visa application

Good day everyone!

I just want to know if my american husband can file K3 visa for me while he is here in the Philippines staying with me since September 2008 and we got married one month after his arrival after 2 yrs of our relationships. I read from the US embassy site that before i get a visa from K3 after it gets approved, my husband should be in his homeland in USA. They have so called DOMICILED. This is what it says ,

The petitioner must be domiciled or residing in the United States at the time the Filipino spouse has a visa interview.The reason for this requirement is simple: immigrant visas are intended to reunite families. There is no reunification to be accomplished - and therefore no reason to issue an immigrant visa - if the petitioner is not residing in the country to which the applicants intend to move.

But my husband is disabled, he can walk but he can't stand walking for a long hours and even get so much tired and so he was assisted by a wheel chair when he came here in the Manila Philippine airport. He was an ex us navy served for 9 yrs and before he left from Alabama , the VA (Veterans Affair) told him that he can use the VA facilities here in the Philippines and can get cheaper medicines that he is getting in the USA but when we went there they said they cannot accomodate my husband only in the Philippines. We heard from some americans we met in the US embassy that it is bcoz low budget! Oh well, So we are now saving money for my K3 and planning to apply it by this November or December of this year 2009. He needs me to go back with him to also assist him.

Lastly, if he will apply for a permanent residency here in phils good for only 1 year (called probationary), Would it affect is filing of K3 for me? That is to save money more faster and paying extensions every 2 months. Any advise please help. God bless all! Hope for a kind respond!
